Problems/Comments

Oil product sheening on Eskimo Creek downhill from Eddie's Fireplace Inn. State lead cleanup work. A Hart Crowser 1999 report states that the data suggested that the former heating oil UST at Eddies Fireplace Inn as the source of soil and groundwater contamination at MW-5, and in the groundwater downgradient of the former UST at MW-1 and 3. The report also states that the former UST is likely the source or a contributing source of floating hydrocarbon encountered during the June 1999 Hart Crowser investigation, and that this is potentially due to an arctic grade diesel release from the former UST. In a 7/25/00 memo from Philip Services to ADEC that was received at ADEC on 7/25/00, Philips provided a summary of the work contracted by ADEC that was performed at Eskimo Creek from 1/1/00 - 6/30/00. The report noted that a sample of floating product was sent to Worldwide Geosciences for GC analysis on 6/24/00. Also, that Worldwide reported that the sample of floating product showed it was a home heating oil, a diesel fuel oil, and not JP-4 or JP-8. The product was also estimated by Worldwide Geosciences that the fuel had been severely biodegraded in the subsurface on the order of 20 years. Last staff assigned was Dronenburg, Frechione and Sundet (2001). In fall 2001, an interception trench was installed to recover free product at the toe of the bank behind Eddie's Fireplace Inn and above the mean high tide level. About 70 cy of contaminated soil was removed and placed into a lined cell at the local landfill to be treated at a later date. In fall 2002, about 35 cy of contaminated soil was removed between the interception trench and the east bank of Eskimo Cr. In summer 2003, the soil was thermally treated by Cascade Environmental Services where the contaminated soil was stockpiled at the local borough's landfill.

11/10/1994 Update or Other Action In follow-up to EH's sampling, Wright of WDO collected three samples at the site under COC; sample 1 oil product sheen from the creek; sample 2 water from the creek; and sample 3 water from the seep location. Sample 1 of the product flowing into the creek measured 280 mg/l benzene, 1,600 mg/l toluene, 2,500 mg/l ethylbenze, 15,000 mg/l total xylene, 320,000 mg/l GRO and 250,000 mg/l DRO. Ray Dronenburg
1/24/1995 Update or Other Action (Old R:Base Action Code = CORR - Correspondence (General)). Letter sent to PRP, i.e., Mr. Oaks, indicating the contractor they chose to perform a tank tightness test is not qualified to do so. The letter also reiterated that in a conversation with Dronenburg prior to Christmas 1994, that Mr. Oaks stated that he would perform a tank tightness test. Also, the letter indicated potential for ADEC to undertake cleanup at the expense of the RP if proper action is not taken by the PRP. Ray Dronenburg
3/24/1995 Update or Other Action Dennis Lundine inspected the site at the request of PM Dronenburg. Lundine was informed by Eddie's Fireplace Inn's Bar Manager Sissy McDeronett that the UST tank tightness test (TTT) had not been performed and that Mr. Oaks was in Anchorage. McDeronett stated that the test was not performed because the Bristol Bay Contractor did have the right equipment. Lundine inspected the furnace room and did not witness any leaks. However, Lundine saw several barrels in the drainage and what appeared to be barrels in the side of the bluff on the north side of Eskimo Creek. Lundine also interviewed two individuals that stated that they worked on the site when the bluff was landfilled. The two individuals noted that they hauled in debris and materials from King Salmon AFB, including everything from drums to machinery. Ray Dronenburg

PRP notified that the actions taken to have a TTT performed are unsatisfactory and at this point they are considered the RP. 2/22/1999 Update or Other Action In a letter dated 2/22/99, ADEC informed Mike Swain, the new owner/manager of Eddies Fireplace Inn, of the contamination. The previous owner,Eddie Oak, had recently passed away. The letter also requested that as the new owner he is a PRP and that he provide a response to the letter whether he was going to investigate the spill or not because the previous owner, Mr. Oaks, had not fully addressed all of the questions that ADEC requested to be addressed in earlier letters issued to him. The letter informed Swain of DEC's cost recovery policies and that if ADEC did not hear back from Swain by 3/31/99, that the State may assume the lead in the cleanup of this site and bill Swain of its expenses if he was determined responsible for the spill. 7/29/1999 Update or Other Action The Hart Crowser site characterization report dated 7/26/99 was received by ADEC on 7/29/99. Four monitoring wells were installed and four well points were installed at the base of the bluff, and the seep was sampled. The report identified soil and groundwater contamination but failed to fully identify a source whether the former heating oil UST or a separate diesel spill. Therefore, additional characterization work was recommended. Data showed that groundwater flowed to the west at a gradient of 0.006 ft/ft, the water table was about 23 ft. bgs; in the 4 MWs benzene was up to 0.1 mg/L (MW-1), GRO up to 3.7 mg/L (MW-3), DRO up to 6.4 mg/L (MW-1), and toluene, ethybenzene, total xylenes and PAHs were below cleanup levels; for the 4 well points the only COCs above cleanup levels were for DRO and benzene detected both in WP-3 at 250.0 mg/L DRO and 0.0053 mg/L benzene; for soil the COCs above cleanup levels for WPs and MW borings DRO was only above 250 mg/kg in surface samples of WP-2 (5,100 mg/kg) and WP-3 (20,000 mg/kg), however all benzene samples were above its 0.02 mg/kg cleanup level in both MW and WP samples. Petroleum contamination observed in MW-1 between 12.5 and 15.5 ft bgs, hydrocarbon odors present in MWs-1 and 3 & WPs-2 and 3, floating product observed of 1.5 ft thick in WP-2. Jim Frechione

11/5/1999 Site Characterization Workplan Approved The work plan dated 11/3/99 for additional site characterization work by Hart Crowser was approved by ADEC on 11/5/99. 11/12/1999 Update or Other Action In a 11/12/99 memorandum from Philip Services to ADEC that was received at ADEC on 11/15/99, Philips provided a summary of the work performed at Eskimo Creek from 8/30/99 - 10/20/99 under NTP 1820195105. The memorandum reported installing 7 six inch recovery wells, IDW soil and absorbent stored in 3 55 gallon drums, and skimmers installed to aid in recovery of product in the wells. Jim Frechione

12/10/1999 Site Characterization Report Approved The "Eskimo Creek Site Assessment" report dated 12/10/99 was received by ADEC on 12/10/99. The report was in subsequence to Hart Crowser's additional site characterization to investigate identify the source of the seep. Field work was conducted November 9 and 10, 1999. NTP 1820121312A. The report noted that two monitoring wells were installed (MW-5 and -6); sampling of the monitoring wells occurred except MW-1 and -4 could not be sampled because of problems encountered; and, GRO (up to 1,100 mg/kg), DRO (up to 9,200 mg/kg), benzene (up to 2.0 mg/kg), toluene (up to 9.6 mg/kg) and ethylbenzene (upt o 27.0 mg/kg) exceeded Method 2 (contamination found in all five samples from 4-20 ft bgs & for most of these COCs) and Table C cleanup levels at MW-5. No contamination was detected in the lab or observed visually or olfactory in MW-6. The report also stated that the data suggested that the former heating oil UST at Eddies Fireplace Inn is the source for the DRO, GRO and BTEX detected in soil and groundwater at MW-5 near the former UST, and in groundwater downgradient at MW-1 and 3. Also, the report noted that it was likely the source or a contributing source of floating hydrocarbon encountered during the June 99 investigation. 12/30/1999 Update or Other Action In a 12/30/99 memorandum from Philip Services to ADEC that was received at ADEC on 12/30/99, Philips provided a summary of the work performed at Eskimo from 10/20/99 - 12/31/99 under NTP 1820195105. 5/1/2000 Update or Other Action On 5/1/00, Regina Williams of Platt Environmental inspected the site and MWs, and noted that a visible sheen was in the creek, and about 1/2 inch product in recovery well-3. Also, she checked the monitoring wells, but she could not find MW-4 or 6. Jim Frechione
5/9/2000 Update or Other Action Platt Environmental inspected the recovery wells and noted 2 gallons of POL tainted groundwater in recovery well 3 (R3). Recovery efforts were employed and the wells will continue to be monitored. She noted that the material in R3 was not the pure product observed the week before. 7/25/2000 Update or Other Action In a 7/25/00 memorandum from Philip Services to ADEC that was received at ADEC on 7/25/00, Philips provided a summary of the work performed at Eskimo from 1/1/00 - 6/30/00 under NTP 1820195105. The memorandum noted that this was the last memorandum of the NTP that would expire on 6/30/00 and that since a final report was not requested in the NTP, that the findings within the three memos would act as a final report (other memos dated 11/12/99 and 12/30/99). The 7/25/00 memorandum reported findings of monitoring events that were performed by Platt Environmental. In addition, the report noted that a sample of floating product was sent to Worldwide Geosciences for GC analysis on 6/24/00. Per Geoff Kany of Philip Services and Regina Williams of Platt Environmental who collected the sample, the sample was collected at recovery well R3. Also, that Worldwide reported that the sample of floating product showed it was a home heating oil, a diesel fuel oil, and not JP-4 or JP-8. The product was also estimated by Worldwide Geosciences that the fuel had been severely biodegraded in the subsurface on the order of 20 years. 8/16/2000 Institutional Control Record Established On 8/16/00, Commissioner Brown signed a certificate of lien for state expenditures for the oil spill at Eskimo Creek seep against all property of Lucy Oaks as conveyed in the Quitclaim Deed signed on 2/15/89, recorded 3/7/89 Book 20 Page 842 in the Kvichak Recording District. The lien noted that at that time the state had expended $76,378.04. Rich Sundet
8/22/2000 Update or Other Action On 8/16/00, Commissioner Brown signed a lien against all property, real or personal, belonging to Lucy Oaks within the Kvichak Recording District, including but not limited to all real property conveyed in the Quitclaim Deed signed on 2/15/89 recorded on 3/7/89 Book 20 p. 842 in the Kvichak Recording District. The lien is to secure payment of expenditures plus interest by the State for the costs of response or remedial action resulting in the spill at Eskimo Creek near Eddie's Fireplace Inn. Earlier in a letter dated 7/6/00, the A.G.'s Office provided Lucy Oaks' attorney an executed Agreement and Release regarding the transaction with Mr. Swain. The letter informed the respondent's counsel that once the agreement (i.e., Oaks was liable for the cleanup because she was/is the property owner and Swain was not liable for the past contamination) was signed to send back copies to the A.G.'s. Office. The letter notified counsel that the Agreement and Release was based upon several conditions including that: 1) A bill would be sent by the A.G.'s. Office for $76,374.04 for costs incurred through 1999 and other bills will be sent as expenses are incurred. 2) Noted that if a recent sample confirmed that the contamination was heating oil, ADEC would record a lien against the property (if it was not heating oil, a lien would not be recorded and item 3 would not apply). 3) As long as Mrs. Oaks pays at least $200.00 each month against her obligation to DEC, ADEC will not foreclose its lien until June 2004. Payments should be received by the 15th of each month starting 9/15/2000 at the A.G.'s office. 4) The obligation to ADEC will accrue interest at the statutory rate unless a waiver is granted. 12/19/2000 Update or Other Action On 12/19/00, ADEC received the report "Fuel Recovery and Site Monitoring Report for Eddies Fireplace Inn's Eskimo Creek Seep" dated 12/15/00 that was prepared by Platt Environmental. Platt Environmental was contracted by CSRP to perform this work under contract 50-5044-01. The report stated monitoring was performed from 8/15 - 11/30/00. 10/31/2001 Meeting or Teleconference Held Sundet, Frechione and Harwood met with Fred Brown of S&W with Wayne Dolezal on teleconference to discuss the draft work plan, and CSRP's and F&G's comments. As the result of that meeting, it was determined to perform a phased project with work scheduled for above high tide line to occur in November 2001 and work, i.e., excavation of the highly contaminated soils adjacent to creek, would be done in spring 2002. The work in spring 2002 would be performed dependent upon findings during fall 2001, and an amended proposal would need to be submitted if ADEC elected to do this work. The later work would need to include surveying of creek elevations to determine when the work could be done when the tide was out, and excavation and off site thermal treatment of those contaminated soils near the creek. 11/7/2001 Cleanup Plan Approved On 11/7/01 in a discussion with Robert Braunstein of S&W, Sundet verbally approved S&W's revised and final work plan titled "Interim Remedial Action Work Plan Eskimo Creek, King Salmon" dated November 2001, which was received by ADEC on 11/5/01. The changes incorporated the comments made by ADEC on the draft plan and reflected that the work would be done in a phased approach per the 11/2/01 meeting with DEC. The verbal approval requested that on p. 14 of the plan under the section titled "Segregation and testing of clean material" that the sentence "The sample with the highest field screening will also be analyzed for VOCs ... by SW8260 and RCRA metals by SW 6000/7000" be moved to the section "Post-treatment soil sampling." In addition, CS requested that S&W confirm whether the access path as shown in Figure 3 needs to be installed to the north of the proposed interception trench versus as shown on the south side of the trench. 11/16/2001 Update or Other Action On 11/16/01, CSRP received the final report by Platt Environmental (i.e., Regina Williams) for monitoring work that she performed regarding the Eskimo Creek seep between 4/1 - 10/30/01. The contract was not to exceed $5,000 for the recovery and containerization of product collected from the recovery wells from 4/1/01 to 10/30/01. ADEC Service Contract Number 50-5049-01. The report noted that 29 monitoring events were performed between 4/1 - 10/30/01, the amount of product recovered was directly related to the tide and groundwater levels, most product recovered was from RW3 and secondly from RW7, product was present in RW5 and 6 during certain tides, RW1 and 2 were always dry, RW4 was jacked out of the ground, absorbent boom was placed into the recovery wells to absorb product when Platt Environmental was not at the site, and about 25 gallons of oil/water mixture was recovered with about 10 gallons of the oil/water added to drums on site and 15 gallons brought to the "used oil" tank at the Bristol Bay Borough Landfill. 11/16/2001 Update or Other Action In a submittal dated 11/16/01, S&W requested additional funding to implement their work plan because winter conditions encountered, the water table was two feet below expected necessitating further excavation, and DEC's decision to remove 2 inches of free product that collected in the trench were beyond the scope of the original scope of work. 11/17/2001 Update or Other Action In accordance to its work plan, between November 8 and 17, CSRP's term contractor Shannon and Wilson constructed the access road and excavated test pits to delineate the contamination near Eskimo Creek, and installed an interception trench to recover product. The interception trench was 123 feet long and in one area near one of the two seeps flowing into Eskimo Creek, approximately two inches of petroleum product was observed. Approximately 15 gallons of product/water mixture was removed from the trench prior to completion of the system. Rich Sundet

The following deviations occurred, but not limited to, the following: no hand borings were advanced on the upper portion of the bluff, however hand borings were performed in the tidal area and to delineate the length of the interception trench; no measurements were taken from MW-3 because a stockpile was placed over that well; samples were not collected from drums of oily waste generated from previous work activities because the contents were frozen; the access road came in from the north vs the south; and visibly impacted soil was left in place and used as backfill during trench activities. 1/15/2002 Update or Other Action At CS's request, on 1/15/02 Regina Williams of Platt Environmental confirmed that she collected the sample on 6/24/00 at Recovery Well R3. A Philip Service's 7/25/00 memorandum reported findings of monitoring events that were performed by Platt Environmental. In addition, the report noted that a sample of floating product was sent to Worldwide Geosciences for GC analysis on 6/24/00. The Worldwide report stated that the sample of floating product showed it was a home heating oil, a diesel fuel oil, and not JP-4 or JP-8. The product was also estimated by Worldwide Geosciences that the fuel had been severely biodegraded in the subsurface on the order of 20 years. Earlier on 1/13/02, Geoff Kany, formerly of Philip Services, also noted to CS that he believed that Platt Environmental had collected the sample taken on 6/24/00 at R3. Rich Sundet

10/7/2002 Update or Other Action Shannon & Wilson began work implementing its final workplan dated October 02, which was received at DEC on 10/3/02. Groundwater monitoring wells were sampled; and between 10/10-12, contaminated gravel/sand was removed from the area below mean high tide, i.e., downhill from the interception trench, at the groundwater interface and replaced with clean grave/sand and the existing overburden. In addition, the bluff was landscaped that was recontoured during Phase I activities performed in fall 2001. About 70 cubic yards of contaminated soil was removed and stockpiled at the Bristol Bay borough along with about 60 cubic yards of contaminated soil that had been removed during Phase I activities. 4/1/2003 Update or Other Action On 4/1/03, CSP received S&W's report "Phase II Interim Remedial Action Eskimo Creek" dated March 03. The report briefly summarizes the Phase I activities (installation of the interception trench in fall 2001) and describes in detail the work perfomed in Phase II. The Phase II work consisted of moving back 69 cubic yards of overburden in the area below mean high tide (MHT) and excavating out about 35 cubic yards of highly petroleum contaminated soil that was impacted at the groundwater level and the smear zone. The area excavated was between Sump 1 of the interception trench and the east bank of Eskimo Creek. The displaced contaminated soil was backfilled with clean gravelly soil and the overburden with vegetation was placed back over the imported clean soils. The contamianted soils were transported to the borough landfill where it was placed in the liner with the approximately 70 cubic yards of soils removed during the Phase I work. The contaminated soil is planned to be treated at the landfill using a thermal treatment system in summer 2003. The report also notes that during the excavation that recovery wells R1 - R4 and well point WP-2. Also that WP3 and WP4 were not found during the October 2002 field work and believed were destroyed. The four recovery wells removed were replaced in their nearby locations and designated as WPA, WPB and WPC using the same wells as those that were removed. Rich Sundet

The letter grants Cascade to operate as an off-site treatment factility to thermally treat about 100 cubic yards of petroleum contaminated soil that was generated from DEC at the Eddie's Fireplace Inn spill. 7/2/2003 Update or Other Action On 7/2/03, CSP received from S&W a report of their ongoing product recovery monitoring efforts dated 7/2/03. The report noted that up to 1.25 inches of product was detected during the monitoring events between 4/29 and 6/28/03. Approx. 14 gal. of product was removed from sump 1 and 4 gal. from sump 2. A total of 42 gal. of product has been removed from the interception trench since monitoring began in 11/2001. Rich Sundet

The report noted that MW 1 and MW 5, which are located just downgradient towards Eskimo Cr. from the former UST, exceeded Table C cleanup levels. The following COCs exceeded Table C levels in: MW1 GRO at 3.13 mg/L; DRO at 292 mg/L; RRO at < 10.8 mg/L; benzene at 0.0194 mg/L. MW5: benzene at 0.0182 mg/L; DRO at 26.4 mg/L; RRO at < 2.66 mg/L. 8/27/2003 Update or Other Action On 8/27/03, CSP received a S&W report of soil samples from the contaminated soil that was treated by Cascade and analytical data from samples collected from under the liner after the contaminated soil was moved and treated. The data showed that the treated soil were below Method 2 cleanup levels (non detect for DRO and RRO, and benzene, ethylbenzene and toluene; and one sample was 0.742 mg/kg total xylene). The data also showed the following DRO concentrations (in mg/kg) of 7 samples collected under the liner: DRO 186 DRO N/D DRO 234 DRO 328 DRO 129 DRO 1,070 DRO 358 In comparison, the highest background sample collected before the liner was installed and contaminated soil placed on it was the following: DRO at 166 mg/kg and RRO at 683 mg/kg. 10/8/2003 Update or Other Action On 10/8/03, CSP received a quarterly report from its consultant S&W dated 10/7/03 reporting the ongoing product recovery effort. The report also noted that the abt. 100 cubic yards soil removed during the Phase I and Phase II remedial work was treated in August 03. The last report was a March 03 data report. This October 03 report documents activities from 5/20 to 9/28/03. During this time product in sump 1 ranges from .25 - .75 inches and in sump 2 from a sheen to .25 inches. During this time abt. 10 gal. of product was removed from the two sumps. Cumulatively, abt. 72 gal. of product has been removed from the two sumps since monitoring began in 11/01. 62 gal. of product has been transported off site for proper disposal while 10 gal. remain on site. 4/13/2004 Meeting or Teleconference Held In a meeting on 4/13/04 between Chris Kennedy and Kay Rawlings of DOL and Sundet of DEC with Jay Durych, legal counsel for Lucy Oaks, the past and potential future agreement to address cost recovery was discussed. The current agreement expires in June 04 which necessitates a new agreement or an amended one. Durych agreed to do further research and discuss the options with Ms. Oaks and the operator Mike Swain. Sundet noted that DEC has basically addressed the free product issue but for the next three years plan to spend about $15,000 annually at the site performing yearly groundwater monitoring, product removal/disposal from the trench and recovery wells, and reviewing brief contractor reports of these activities. Depending upon findings, dissolved phase remedial work may be needed. Rich Sundet

2/16/2005 Update or Other Action On 2/16/05, DEC received from S&W copies of their final report "October 2004 Water Sampling and Free-Phase Product Monitoring at Eskimo Creek, King Salmon" dated 2/15/05. The report shows that of the 3 surface water samples collected from Eskimo Creek, none showed any detection of petroleum hydrocarbons. In addition, MW5 had the highest levels of contaminants with 0.0283 mg/L benzene and 94.0 mg/L DRO. MW5 is located just downgradient from the former UST connected to Eddie's Fireplace Inn. Abt. 1 gal. of free product was removed from the interception trench, no product was observed in monitoring points MP1, MP2, MP3 or MP4, or MPA or MPB, and sheen was observed in monitoring point MPC. DRO was detected at 9.08 mg/L and 7.39 mg/L in MPB and MPA, respectively. Historically, contaminant levels in MWs 1, 3 and 5 (where contamination has been detected) do not show a definite trend. DRO levels in MW1 were 0.1 mg/L in 1999, 9.99 mg/L in 2002, 292 mg/L in 2003 and 36.0 mg/L in 2004. In MW3, DRO was 6.0 in 1999, 1.24 mgL in 2002, 0.843 in 2003, and 3.00 mg/L in 2004. In MW5, DRO was 4.6 mg/L in 1999, 70.0 mg/L in 2002, 26.4 mg/L in 2003 and 94.0 mg/L in 2004. Rich Sundet

7/6/2005 Update or Other Action On 7/6/05, DEC received S&W's report "Free Phase Product Recovery System Operation and Monioring Eskimio Creek" dated 6/30/05. The report compiled product recovery monitroing activities from 12/9/04 to 6/10/05. The report noted that recovery points MP1-MP4 were monitored and the two sumps in the interception trench. Product was noted in MP1 up to 1.0 inch thick and up to .25 inch in MP3 but no sheen was observed in the other two monitoring points. Product was detected up to 0.5 inch in Sump 1 and a sheen observed in Sump 2. A total of about 7 gal. of diesel product was recovered since 10/05 and 85 gal. total from all monitoring points since 11/01. The report also noted that the purgewater generated was disposed of at Emerald Alaska in Anchorage and the fuel burned for energy recovery. Rich Sundet

9/15/2005 Update or Other Action On 9/15/05, the Attorney General's Office updated the agreement between the State and Lucy Oaks. The new terms noted that the total to date owed to DEC was $442,391.79 for its cleanup oversight, the State would update its lien against the subject property under AS 46.08.075, that Lucy Oaks would reimburse the State $400.00/month and DEC would forbear foreclosing its lien up to and including 10/15/2011, the parties agree to toll the running of any statutes of limitation applicable to the States claims through 10/15/2011, and the promise of forbearance is not transferable. The agreement was signed by Christopher Kennedy for the AGs Office and by Mrs. Oaks and her attorney Jay Durych. The 2005 agreement is in follow-up to the 7/6/00 agreement. 7/3/2006 Update or Other Action On 8/7/06, ADEC provided comments to S&W regarding their draft status report of work performed between 4/1 and 6/9/06 at the site which was the collection and disposal of product/absorbents. DEC received the 6/30/06 dated draft report via email from S&W on 7/3/06. During the above specified timeframe, all fluid in the interception trench, and monitoring/recovery points were frozen during the April and May 2006 sampling periods and during the 6/9/06 monitoring event, no measureable product was detected in these monitoring devices. Since 7/1/06, one gallon of product was removed (from Sump 1 and MP1 in 10/06) and about 86 gallons of product removed from the two sumps and the monitoring points since 11/2001. After incorporating DEC's comments, S&W issued the final report "Free-Phase Product Recovery System Operation and Monitoring, Esimo Creek, King Salmon" on 8/7/06 (DEC received the final report on 1/9/07). 9/12/2006 Update or Other Action On 9/13/06, DEC received laboratory data from S&W from their groundwater sampling event at the site this summer. Data showed that the on site public drinking water well showed non detect for DRO, RRO and VOCs. S&W noted that one of the six onsite monitoring wells (MW5 nearest the UST) was not found and S&W would later this summer attempt to locate it and sample it. The groundwater monitoring data showed that the upgradient and cross gradient wells (i.e., 2, 4 and 6) were non detect for fuel, but that MW1 and MW3 still showed contamination with MW1 showing similar levels of benzene at 0.064 mg/L and MW3 showing benzene at an order of magnitude lower at .008 mg/L from the last sampling event in 2002. (CSP conveyed the laboratory report with the drinking water findings to its DW Program on 9/13/06). Rich Sundet

12/4/2007 Update or Other Action On 12/4/07, DEC provided comments via email to S&W regarding their draft report "Groundwater Sampling and Free-Phase Product Monitoring at Eskimo Creek, King Salmon, Alaska" dated 11/29/07. DEC received the draft report on 11/30/07. The report covered field work performed at the site from 8/21/06 to 6/18/07. During the time period the onsite public drinking water well and existing 6 monitoring wells were sampled on 8/22/06, and free product was monitored and recovered from existing recovery wells and interception trench periodically during the subject time frame. Analysis showed no sampled analytes were detectable in the drinking water sample. Detectable product was observed in only Sump 1 of the interception trench (two sumps monitored) and Monitoring Point 1 (2 recovery wells and 5 monitoring points were monitored). A total of two gallons of free product was recovered at Sump 1 and MP1 during monitoring between 8/06 and 6/07. Groundwater exceeded Table C clenaup levels for DRO at MW 1 and 5 (up to 21.7 mg/L - at MW5), and for benzene at MW1, 3 and 5 (up to 0.0642 mg/L at MW1). S&W noted that it could not discern a definite pattern of the analytical data for MWs 1, 3 and 5 as the data has been fluctuating since monitoring has occurred in 1999. Data presented from product recovery since fall 1999 shows that most product was recovered in the first several years that the interception trench was installed (fall of 2001) and has been decreasing since e.g., in 2005 8 gal. recovered, in 2006 to 6/07 2 gal. recovered. 12/26/2007 Update or Other Action On 12/26/07, S&W finalized their report "Groundwater Sampling and Free - Phase Product Monitoring at Eskimo Creek, King Salmon, Alaska." DEC received final copies of the report on 4/8/08. The report noted that on 8/22/06 MWs 1-4 and MW-6 were sampled and the on site drinking water well, and that MW5 could not be located but was later detected and sampled on 10/3/06. Also that product recovery from the two sumps in the interception trench occurred from 8/21/06-6/18/07 (August and Sept. 06, and June 07), and that monitoring of the 5 monitoring pts. (MP1-5) and sumps 1 & 2 in the trench, and recovery wells 6 and 7 were measured for product during this time. Product was detected and recovered from Sump 1 (abt. 2 gallons) and 0.125 inches of product detected in MP1. Thus far abt. 84 gal. of product has been recovered since the interception trench was installed in 2001. No detections of sheen was observed in Eskimo Creek. No detections of any contaminant was found in the drinking water well. DRO (21.7 mg/L in MW5 and 11.3 mg/L in MW1) and benzene (0.0642 mg/L in MW1, 0.0088 mg/L in MW3, and 0.0166 mg/L in MW5) and RRO (5.77 mg/L in MW5) were detected above Table C cleanup levels. Contamination in these three monitoring wells were similar to recent past sampling events with the last event on 10/1/04. The report also noted that the bank was stable and revegetation was stable where the interception trench and where the road to construct it. Rich Sundet

8/11/2008 Update or Other Action In an 8/11/08 Shannon&Wilson (SW) report (received at DEC on 11/4/08), SW provided summary information regarding their free product recovery operation and on property drinking water well sampling. Product was measured in the interception trench, 2 recovery wells and 5 monitoroing points generally on a monthly basis when the creek was not frozen, i.e., between June and October. During this report, about 3 gallons of free product was recovered between 8/20/2007 and 6/24/2008. About 60 gallons of oily water was recovered by Platt Environmental between 8/18/2000 and 10/17/2001 and 87 gallons of product was recoveed from the sumps by SW between 12/2001 and 6/2008. Monitoring/product recovery occurred on 8/20, 9/24, 10/16/ 10/23/2007, and 5/6 and 6/24/2008. The report noted that a sample collected from the on property drinking water well showed non detect for VOCs (EPA Method 524.2), RRO (AK 103), and DRO (AK 102). Per DEC's request, on 12/8/08, S&W provided a completed laboratory checklist for the report and DEC inserted the checklist into the report. Rich Sundet

It noted that Recovery Wells R6 and R7 that were surveyed in 10/04 were not located during the subject monitoring time; product thickness was measured in the 2 interception trenches and 5 monitoring points on a monthly basis when the water was not frozen; monitoring points MPA, MPB and MPC were filled with mud so no measurements were made; sorbent pads were used to removed product in the sumps and about 2.5 gal. of product was removed; the Public Drinking Water well was sampled for VOCs, DRO and RRO but all COCs were below their detection levels; and, the bank where the interception trench had been installed in 2001 was evaluated and found to be stable. DEC had received a draft of the document via email on 6/30/10 and DEC commented upon it on 5/17/11 after discovering DEC had not received the final report. The report notes that a closed loop survey was performed on 8/28/09 and the results showed that groundwater flowed to Eskimo Creek; monitoring wells (MW) 1-6 (MW3 was not sampled because of the amount of free product) plus the on property drinking water well and Sump 1 were sampled - product was detected in MW3 (0.05 ft) and sheen observed in MW5 and in Sump 1 while the DW well showed non detect for all contaminants of concern (COCs); VOCs (including benzene up to 0.0417 mg/L in MW1)and DRO (up to 33.7 mg/L in MW5) were detected above Table C cleanup levels in MW1 and MW5 and Sump 1. MW5 was also sampled for SVOCs and bis(2-Ethylhexyl)phthalate (0.073 mg/L), 2-Methylnapthalene (0.17 mg/L) and naphtahalene (0.078 mg/L) were detected above Table C levels; comparison to prior sampling events showed that free product was detected in MW3 for the first time, and BTEX and DRO concentrations were about the same as recent past years in MW1 and MW5 which are also located immediately downgradient from the former UST; 0.6 gallons of product was recovered from Sump 1 and 0 gallons from Sump 2 for a total of 90 gal. recovered by S&W since 2001; monitoring points MP1-MP5, MPA, MPB and MPC were not sampled because of a lack of water or turbidity; MW6 was repaired; no sheen was observed in Eskimo Creek; and observations showed that the bank remained stable with vegetation where the interception trench was installed. 6/16/2011 Document, Report, or Work plan Review - other On 6/16/11, DEC provided comments on S&W's draft report "Free-Phase Product Recovery System Operation and Monitorign, Eskimo Creek, King Salmon, Alaska" dated 6/15/11. The report noted that the site was monitored at MP1-5 and Sumps 1 & 2 within the interception trench; MPA, MPB and MPC on 8/31, 9/30; and on 10/21/10 and 5/15 & 5/20/11. Earlier, on 6/16/11, DEC provided comments on S&W's draft report "Free-Phase Product Recovery System Operation and Monitorign, Eskimo Creek, King Salmon, Alaska" dated 6/15/11. The report noted that the site was monitored at MP1-5 and Sumps 1 & 2 within the interception trench; MPA, MPB and MPC on 8/31, 9/30; and on 10/21/10 and 5/15 & 5/20/11. 6/27/2011 Update or Other Action On 6/27/11, DEC issued NTP 18-4002-12027 to S&W for $12,172.17 to implement its proposal dated 6/14/11 to continue recovery of diesel fuel at the existing interception trench and recovery wells at the site, to dispose of that waste, inspect the existing monitoring wellss, update summary table of recovered product, and to inspect/photograph the bank stabilizaiton prior work. 9/1/2011 Update or Other Action In a letter dated 9/1/2011, the Attorney General's Office informed Lucy Oaks that the 2005 tolling agreement with the State ends on 10/15/2011, and noted that Lucy was current on payments according to the agreement and extended an offer to extend the agreement for another six years. 3/1/2012 Update or Other Action On 3/1/2012, DEC issued a letter to Mike Swain in follow-up to DEC's conversation with Swain on February 7, 2012. In that conversation, Swain requested a summary to date of the State’s oversight costs associated with the cleanup of the site referred to as Eskimo Creek - Eddie’s Fireplace Inn on our Contaminated Sites Program’s database. In addition, during that conversation Sundet noted that he would provide Swain with several of the numerous reports that have been generated by our term contractor since the State assumed lead on the cleanup. I am providing copies of Shannon & Wilson’s (S&W): • April 2002 report “Interim Remedial Action Eskimo Creek King Salmon” that describes the construction work for the installation of the interception trench in fall 2001. • July 1, 2010 dated report “Groundwater Sampling and Free-Phase Product Monitoring at Eskimo Creek King Salmon” that describes the last groundwater monitoring event that DEC performed at the site as well as the annual free-phase product monitoring/recovery activity. • June 21, 2011 dated report “Free-Phase Product Recovery System Monitoring, Eskimo Creek King Salmon” which is the last report DEC has and discusses the annual free-phase product monitoring/recovery activity. 3/23/2012 Update or Other Action In lieu of Lucy Oaks passing, on 3/23/12, SPAR Director Dietrick signed a lien for $14,866.67 against the estate of Lucy Oaks. Earlier on 8/16/00, Commissioner Brown signed a lien against all property, real or personal, belonging to Lucy Oaks within the Kvichak Recording District, including but not limited to all real property conveyed in the Quitclaim Deed signed on 2/15/89 recorded on 3/7/89 Book 20 p. 842 in the Kvichak Recording District. The lien is to secure payment of expenditures plus interest by the State for the costs of response or remedial action resulting in the spill at Eskimo Creek near Eddie's Fireplace Inn. Earlier in a letter dated 7/6/00, the A.G.'s Office provided Lucy Oaks' attorney an executed Agreement and Release regarding the transaction with Mr. Swain. Rich Sundet
8/6/2012 Document, Report, or Work plan Review - other On 7/31/11, DEC received S&W's final report "Free-Phase Product Recovery System Operation and Monitorign, Eskimo Creek, King Salmon, Alaska" dated 7/31/11. The report noted that the site was monitored at MP1-5 and Sumps 1 & 2 within the interception trench; MPA, MPB and MPC on 7/31, 8/19, 8/30; and on 11/4/11 and 5/30/12. A total of 0.9 gal. of product was recovered from Sump #1 during these times (0.4 gal. on 7/31/11, and 0.5 gal. on 5/30/12). Recovery work thru May 2011 showed that to total 91 gallons of product had been recovered in the recovery wells and the interception trench. In addition the report noted that they located monitoring well MW-4, and obtained swing tie measurement for future use and MPA was found full of mud on 5/30/12. Robert Weimer

10/23/2012 Cleanup Plan Approved On 10/23/12, DEC provided comments to S&W via email regarding their draft work plan dated 10/23/12 (and received via email on that date) for FY13 work that included product recovery and performing groundwater monitoring at the existing six monitoring wells and one drinking water well on site. 4/30/2015 Update or Other Action Reviewed the August 2014 Free-Phase Product, Groundwater and Surface Water Monitoring Eskimo Creek- Eddies Fireplace Inn King Salmon, Alaska. During the 2014 site work monitoring well MW2, recovery wells R6 and R7 were decommissioned. Samples could not be collected from MW3 and MW4 because they were dry nor could a sample be collected from MW6 because it was jacked and needed repair. Groundwater samples were collected from MW1, MW5, MPB, MPC, and Sump 2. At MW1 DRO and benzene exceeded groundwater cleanup levels at 3.09 mg/L and 0.0556 mg/L, respectively. At Sump 2 DRO and RRO exceeded groundwater cleanup levels at 66.8 mg/L and 2.04 mg/L, respectively. Surface water was collected at sites SW5 (upstream), SW4 (downstream), and SW1 (adjacent to interceptor trench). There were no analytes that exceeded groundwater cleanup levels nor did TAH and TAqH exceed the most stringent levels for surface water use class. Lisa Krebs-Barsis

11/13/2017 Site Characterization Report Approved Site characterization work was preformed in May 2017 which consisted of sampling surface water, groundwater, monitoring points and sumps as well as decommissioning a monitoring point. Surface water samples SW-2, and SW-3 did not contain detectable concentrations of benzene, toluene, ethylbenze, xylenes (BTEX), or polyaromatic hydrocarbons (PAHs) above ADEC cleanup levels. Sample SW-1 contained detectable concentrations of acenaphthene, fluorine, naphthalene, and phenanthrene. Naphthalene in SW-1 was detected at 171 ug/L which exceeds the ADEC groundwater Table C cleanup level of 1.7 ug/L. Additionally total aqueous hydrocarbons(TAqH)was calculated for SW-1 to be 181 ug/L which exceeded ADEC (surface) water quality standards of 15 ug/L for TAqH. Samples were collected from Sumps 1 and 2. Sump one was found to have 0.02 feet of product in the sump, and a sheen was observed in sump 2. Sample Sump 2 (SW-2) contained diesel range organics (DRO) at 139 mg/L and residual range organics (RRO) at 2.39 mg/L exceeding ADEC cleanup levels. In addition gasoline range organics (GRO), BTEX, and PAHs were also detected in SW-2. Monitoring well samples were collected from MW-1 and MW-5. Both wells exceeded ADEC Table C cleanup levels for DRO (MW-1 at 4.82 mg/L, MW-5 at 35.8 mg/L), 1,3,5-Trimethylbenzene, and naphthalene. In addition MW-1 was above ADEC cleanup levels for benzene and xylenes. MW-3 was not sampled due to 0.16 foot of free product in the well, and MW-4 was not sampled due to low water levels. Monitoring Point (MP) 1 was found to have a sheen, however the water was too low to sample and Monitoring points MP2, MP3, and MP4 were dry. Monitoring Point MPA was decommissioned in accordance with ADEC guidance. Chelsy Passmore

1/17/2020 Site Characterization Report Approved The ADEC has reviewed the “2019 Eddie’s Eskimo Creek Report”. Fieldwork consisted of groundwater sampling, surface water sampling, free-phase product recovery, and inspection of preexisting monitoring wells and well points at the site. Groundwater samples were collected from MW-1 and MW-4. Monitoring Points (MPs) MP2, MP3, and MP4 were dry, there was sheen in MW-3, MW-5, and Sump 2, and free product in Sump 1 (0.01 ft) and MP1 (0.03 ft), which prevented sampling at those locations. Samples collected were sampled for GRO, DRO, RRO, VOCs and PAHs. MW-1 contained concentrations of DRO, 1,2,4-trimethylbenzene, 1,3,5-trimethylbenzene, benzene, ethylbenzene, naphthalene, xylenes and 1-methylnapthalene above ADEC Table C groundwater cleanup levels. MW-4 did not contain contaminant concentrations above ADEC cleanup levels. Absorbent socks were placed in MP1, Sump 1, Sump 2, and MW-3 to absorb product. Three surface water samples were collected from Eskimo Creek (SW-1, SW-2, SW-3) and analyzed for benzene toluene, ethylbenzene, xylenes and PAHs. Total aromatic hydrocarbons and total aqueous hydrocarbons were calculated from the results. Niether the TAH nor the TAQH exceeded ADEC surface water standards. There were no PAH concentrations that exceeded ADEC standards. Chelsy Passmore

7/12/2021 Site Characterization Workplan Approved ADEC project manager talked with the consultant from Weston Solutions about upcoming July 20-21, 2021 field work activities. Work is to follow the workplan approved in 8/22/2019. Goals for this field work event include retrieving and replacing product wicking socks from recovery wells, repairing monitoring wells and collecting groundwater samples. Shawn Tisdell
1/28/2022 Meeting or Teleconference Held Site project manager (PM) talked with property leasee and business owner about site management, site history and future plans for the property. The leasee shared that communication from the State was inconsistent and asked for additional information including site reports. Several reports have been added to the site link and are available for viewing. The PM discussed that the DEC would be evaluating what additional information would be necessary to move the site to a closure decision and would discuss any options with him. Shawn Tisdell
9/6/2023 Meeting or Teleconference Held DEC staff talked with the owner of Eddie's Fireplace Inn to find out current conditions and discuss winter preparations. Wells and interception trench will be visually inspected, and they will inform us if something looks in need of repair.
