Problems/Comments

In January 2012 a fuel line to a 275-300-gallon aboveground heating oil tank adjacent to a residence at 121 East Chestnut Lane in Haines was severed by snow falling off of the roof. The severed line went undiscovered until after the tank was refilled and immediately thereafter discovered to be empty again. The total volume of diesel released to the ground was estimated at ~250 gallons. Free product was observed in test pits. Initial response actions included application of sorbents, interception ditches, and installation of a ventilation system. Analytical data were not available and the contamination has not been fully characterized.

Extent and degree of soil contamination and a plan to remove the contaminated soil from the property and the neighboring property/ditch. 2. A drinking water well search to make sure that there are no drinking water wells nearby that may become contaminated as a result of this spill. 3. 8/27/2015 Update or Other Action Rec'd a letter from the RP via email stating that they currently have no means to move forward with cleanup. RP also stated that the house is occupied, the vapor barrier is intact, the vapor ventilation system has been removed (after 6 months) after the odor had dissipated months earlier, and that the home and neighboring homes were all on city water. I sent a certified letter today (9/3/15) initiating a Notice of Environmental Contamination and Institutional Controls due to a lack of cleanup action. Danielle Duncan

10/20/2015 Public Notice NOTICE OF ENVIRONMENTAL CONTAMINATION As required by the Alaska Department of Environmental Conservation (ADEC), Grantor, pursuant to 18 AAC 75.375 b (3), Kristine Harder, Grantee, as the owner [and operator] of the subject property, hereby provide public notice that the property located at: 121 East Chestnut Drive, Haines, AK 99827 Lot 43, Meadow Land Subdivision No. 2, according to Plat No. 98-20 has been subject to a discharge or release, regulated under 18 AAC 75, Article 3, as revised April 8, 2012. The property is subject to the following conditions in order to ensure human health is protected until such time that a cleanup can be completed. These conditions, known as institutional controls per 18 AAC 75.375 a (2), consist of the following: 1. Notice Required for any Change in Land Ownership or Land Use If land ownership or zoning of the property changes, the owner or operator of the property is required to notify the ADEC as soon as these changes occur. 2. Excavation Restriction No excavation shall occur on the property without ADEC approval; characterization will have to be completed before excavation activities begin. 3. No Offsite Transport of Contaminated Material Any proposal to transport soil or groundwater off-site requires ADEC approval in accordance with 18 AAC 7.325(i). A “site” [as defined by 18 AAC 75.990 (115)] means an area that is contaminated, including areas contaminated by the migration of hazardous substances from a source area, regardless of property ownership. 4. Contamination of Surface Water Prohibited Movement or use of contaminated material in a manner that results in a violation of 18 AAC 70 water quality standards is prohibited. 5. Groundwater Use Restriction Groundwater shall not be used for drinking water purposes due to possible contamination from the heating oil spill that occurred on the property. Danielle Duncan

7/14/2016 Update or Other Action 3rd request for a work plan # 7014 2120 0001 4210 0933 Spoke to the homeowner and she is going to see about getting a different consultant to provide a work plan. She has limited funding for the cleanup. There are no odors in the home at this time, however, the homeowner is working elsewhere for the summer. The home is on top of gravel fill and the fuel may have migrated behind the house. Danielle Duncan
