Problems/Comments

In October 2014, petroleum-contaminated soil was discovered above an underground diesel heating oil tank during a site investigation at a residential property at 1305 Carat Loop. Diesel range organics were confirmed in soil above DEC cleanup levels. The release was believed to be due to an overfill of the underground tank. Initial remedial activities included removal of approximately 15 cubic yards of contaminated soil. Contamination remained beneath the garage, along a septic line, and near the groundwater interface. Remaining volume of contaminated soil was estimated at 20-30 cubic yards.

Action Information

Action Date Action Description DEC Staff
1/27/2015 Potentially Responsible Party/State Interest Letter Potentially responsible party / state interest letter sent to Safeguard Properties by PERP staff Paul Lhotka. Mitzi Read
6/1/2015 Update or Other Action Workplan submitted to PPR Program (formerly PERP) to excavate tank and conduct soil cleanup. The tank was removed on June 26, 2015 along with 15 cubic yards of contaminated soil. The excavation was 9 by 12 feet and mostly 6 feet deep. Soil screening occurred in the excavation but additional excavation was stopped by the responsible party due to lack of funds. Test pits were dug to the north, south, and west to evaluate the extent of remaining contamination. Groundwater was encountered at 7 feet in a test pit in the middle of the excavation. No analytical soil samples were collected during this effort, but screening results indicated contamination may remain near or under the southwest corner of the garage. Janice Wiegers
8/14/2015 Spill Transferred from Prevention Preparedness and Response Program Spill transferred by PERP staff Paul Lhotka. Spill no. 14309928105; spill date = 10/8/15; substance = diesel; quantity = unknown; source = underground heating oil tank, suspected overfill; PERP file no. 100.02.155. Mitzi Read

9/18/2015 Update or Other Action Contacted consultant (BGES) by email to check on status of cleanup. Janice Wiegers
9/18/2015 Potentially Responsible Party/State Interest Letter PRP letter sent to Somers & Associates, representing Fannie Mae, current property owners. Janice Wiegers
11/24/2015 Update or Other Action Letter sent to Dave Somers (realtor) requesting update regarding work completed at this location within 30 days. Janice Wiegers
12/16/2015 Update or Other Action Corresponded by email with Jake Somers about type of characterization activities that may be needed at the site. Janice Wiegers
5/23/2016 Document, Report, or Work plan Review - other Reviewed and approved workplan from BGES to install three monitoring wells, collected soil samples from monitoring well borings, complete building survey for vapor intrusion pathway, and collect indoor air samples. Contacted consultant to discuss workplan and schedule. Drilling is scheduled for 5/24. Janice Wiegers
7/13/2016 Update or Other Action Received preliminary data tables and figures from BGES. Very little petroleum contamination was found in the soil and groundwater samples from three borings. The groundwater was observed to flow southeast at the time of sampling (late May). Indoor air samples were collected from the crawlspace, living room, garage, and outside. Petroleum did not exceed DEC target levels for indoor or outdoor air in these samples. However, PCE was found in the living room at a high concentration (460 ug/m3). The PCE observed in indoor air does not appear to be associated with the spill from the heating oil tank and is likely associated with some type of indoor activity (e.g., cleaning, etc.) Janice Wiegers
9/26/2016 Update or Other Action DEC sent letter approving the August 2016 report. DEC noted some uncertainty remains regarding the groundwater flow direction and the contaminant levels in groundwater and recommended an additional groundwater sampling event. Groundwater flow direction should also be rechecked, as the regional flow direction is generally to the northwest rather than the southeast. PAHs should be included as a COPC during testing. Janice Wiegers
10/7/2016 Update or Other Action DEC sent second letter to clarify that the previous report was approved and satisfied the workplan requirements, and that additional sampling would be needed to further evaluate the sampling results. Janice Wiegers
11/10/2016 Update or Other Action Notified by realtor that a well is located in the crawlspace. Previously it was believed that the house was served by a water holding tank. Janice Wiegers
1/11/2018 Document, Report, or Work plan Review - other DEC received work plan dated January 4, 2018 and submitted by BGES. The work plan included additional groundwater monitoring and indoor air sampling. DEC approved the work plan but required VOC sampling in at least one monitoring well (preferably the source area well MW-2) DEC also recommended heating the house prior to indoor air sampling. Janice Wiegers
5/31/2018 Update or Other Action BGES notified DEC that indoor air and groundwater sampling would occur on June 5th. Janice Wiegers
11/1/2018 Document, Report, or Work plan Review - other BGES submitted the Vapor Intrusion and Groundwater Monitoring Activities report, dated October 2018. No contaminants were detected in indoor or outdoor air above ADEC target levels for vapor intrusion. Groundwater samples collected from the three on-site monitoring wells and the drinking water well did not contain detectable levels of contamination. Janice Wiegers
1/15/2019 Update or Other Action DEC sent a letter approving the October 2018 report and noting that the three monitoring wells need to be decommissioned prior to site closure. Janice Wiegers
5/10/2019 Update or Other Action Notified of plans for BGES to decommission the three on-site monitoring wells. Janice Wiegers
5/15/2019 Cleanup Complete Determination Issued DEC sent a closure letter to the Somers and Associates on this date. Monitoring indicates any residual contamination from the heating oil spill is not affecting the groundwater or indoor air. Janice Wiegers
8/1/2019 Update or Other Action Contacted Somer and Associates to check on monitoring well decommissioning plan. The plan was delayed, but decommissioning is expected to occur before winter. DEC will check back in mid-September. Janice Wiegers
10/21/2019 Update or Other Action Workplan submitted for decommissioning three monitoring wells. Janice Wiegers
10/22/2019 Update or Other Action DEC received and approved a work plan from BGES for decommissioning the remaining monitoring wells. Janice Wiegers
12/5/2019 Update or Other Action Monitoring well decommissioning report submitted by BGES and Sommer & Associates. MW-1 and MW-3 were removed by Discovery Drilling. The drill rig could not access MW-2, so the screen and a portion of the casing were left in place and filled with sand and bentonite. Janice Wiegers
