On this date, DEC sent a letter to the USFS requesting action on a number of sites. For this site, DEC stated: The USFS negotiated an agreement with Newmont Mining and Dawn Mining to evaluate the presence of contamination at the site under an EE/CA. The USFS held a public comment period on the draft EE/CA in May 2015. To date, the DEC has not received a copy of an action memo or any documentation from the USFS regarding a decision following the completion of the public comment period. It is understood that the USFS will negotiate with other parties to conduct the actual cleanup. DEC hereby requests that by October 10, 2016 the USFS provide an estimated timeline of milestones for the cleanup. |

DEC has reviewed the draft surface water sampling work plan, which details proposed baseline surface water quality data collection prior to and during construction efforts for the Non-Time Critical Action (NTCRA) in which mine rock and mine-affected materials will be excavated site-wide. Water quality samples will be collected from Kendrick Creek in locations of suitable physical habitat for salmonid spawning and rearing, and post-NTCRA sampling will be collected biennially for three years, followed by once every five years thereafter dependent on results. |
