General Conformity - List of Exempt Federal Actions:

  1. Total of direct and indirect emissions are below de minimis (PDF) thresholds
  2. No net increase in emissions:
    1. judicial and legislative proceedings
    2. recurring activities such as permit renewals
    3. rulemaking, policy development and issuance
    4. routine maintenance and repair activities
    5. civil and criminal enforcement activities
    6. administrative actions
    7. routine, recurring transportation of materials and personnel
    8. routine movement of mobile assets (e.g. ships, aircraft, etc.)
    9. maintenance dredging and debris disposal
    10. future activities similar to existing activities
    11. granting of leases, licenses
    12. planning studies
    13. routine operation of facilities, assets, and equipment
    14. transfers of ownership, interests, and titles
    15. designation of empowerment zones
    16. actions by any banking agencies or Federal Reserve Banks
  3. Actions where the emissions are not reasonably foreseeable:
    1. outer continental shelf sales
    2. electric power marketing
  4. Actions which implement a decision to carry out a conforming program
  5. Portion of an action that includes major new or modified stationary sources that require a permit
  6. Actions in response to natural disasters
  7. Research, investigations, studies
  8. Alteration and additions to existing structures as required by environmental legislation/regulations
  9. Direct emissions from remedial and removal actions carried out under CERCLA
