Coastal Zones Excluded from the Portable Oil and Gas Operation Permit By Rule

The coastal zones within the following coastal management districts and coastal resource service areas are excluded from the Portable Oil and Gas Permit by Rule in 18 AAC 50.390:

•  Aleutians East Borough;

•  Aleutians West Coastal Resource Service Area;

•  Bering Straight Coastal Resource Service Area;

•  Kodiak Island Borough;

•  Lake and Peninsula Borough;

•  Skagway Areas Meriting Special Attention;

•  St. Paul ; and

•  Whittier .

The department has found that the permit by rule may be inconsistent with enforceable policies of these districts and service areas.

For the purposes of 18 AAC 50.390 only, the coastal zone boundaries are defined by the following descriptions. While state regulations do not include federal land as part of the coastal zones, federal law requires the enforceable district policies to be implemented to the maximum extent practicable on federal lands. Therefore, the definitions below do include federal land.
