AIR PERMITS PROGRAM REWRITE
REGULATIONS AFFECTING OIL AND GAS DRILL RIGS
Revisions to 18 AAC 50 regarding Oil and Gas Drill Rigs were filed by the Lt. Governor's office on November 3, 2005. They became effective as of December 3, 2005. The revisions to the regulations and the Response to Comments are found below. The public notice for the proposed revisions ended on February 28, 2005.

The Alaska Department of Environmental Conservation has rewritten its air permits regulations. This web page gives information about the Department's progress in that rewrite. The regulations became effective October 1, 2004.

Question:

Question:
Does the state have statutory authority to retain the Pre-Approved Limits
for gasoline distribution facilities to allow them to be considered gasoline
bulk plants.
Answer:
Yes. The department considers the existing authority listed after the
current regulation (18 AAC 50.230), with the addition of AS 46.14.010(a) to
provide adequate authority.
Question:
Does the department intend to use that authority to continue to retain
Pre-Approved Limits for gasoline bulk plants?
Answer:
The department proposes to move the Pre-Approved Limit section to a new
section 18 AAC 50.565, with minor changes. The proposed regulations would
allow the current Pre-Approved Limits to remain in effect. New limits could
be established under 18 AAC 50.565. The proposal would change the name to
Pre-Approved Emission Limits (PAELs) because a new unrelated term in federal
regulation uses the acronym PAL.

Statute Change
On June 6, 2003, the governor signed HB160 into
law. This bill changes the form of the Department's air permit program,
and directs the department to write regulations to implement the changes.
The new statute directs the department to

Write new major
source permit programs to closely follow the corresponding federal
programs; and |
| |
Write a new minor
permit program. |
The Department's air statute, AS 46.14 is shown
in the box below.
As of 10/3/03 this link did not include the changes
made by HB160. This version of AS 46.14 is necessary to understand the
changes made by HB160.
