Pesticide Use Permits & Exemptions
A permit to apply pesticides is required under the following circumstances:
- Application to water
- Aerial application (by aircraft or helicopter)
- Application to state owned or leased land (1 acre or more)
- Application to state owned or leased right-of-way or greenhouse/nursery (of any size)
- Application to property owned separately by two or more persons
Application of antimicrobials used for oilfield operations or treatment of drinking water are exempt from permitting requirements.
An exemption from the pesticide use permit requirements may be granted under the following circumstances (all require written request and approval):
- The Commissioner determines that an emergency exists
- Application is necessary for the safe operation of an airport (to non-public areas only)
- Application is conducted as part of a research project (on 20 acres or less)
