This page provides an historical summary of changes for all versions of DEC regulations Chapter 78 (18 AAC 78) and adopted guidance governing underground storage tanks in Alaska. (Modifications starting with the most recent changes.)
Underground Storage Tank Regulations (Chapter 78) 18 AAC 78 - Revisions Only: (January 30, 2003)

Revisions were made to underground storage tanks and leaking underground storage tanks requirements to
- simplify and clarify the UST prevention, operation and maintenance requirements
- to revise priority ranking scoring for continuing projects and loan priority ranking exemptions for more efficient processing of loans and to be consistent with statutes
- to revise board funding allocation language to address continuing projects and to be consistent with statutes, to revise dispute resolution to allow for more flexibility
- to correct grammatical errors and incorrect cross referencing to other regulation sections
- to eliminate the grandfather clauses that reference old analytical lab methods
- to make improvements to standardize the requirements to assist third party inspectors in the evaluation of operational compliance of UST systems
- to eliminate duplicative leak detection requirements in the regulation
- to update codes of practices, to make improvements to promote clarity of intent and purpose of the regulations
- to modify offsite or portable treatment facilities requirements
- to update references to refer to a newer version of UST Procedure Manual
- and other reference documents and guidances
- and to refine the regulations to be more consistent with corresponding regulatory requirements in the Oil And Other Hazardous Substances Pollution Control Regulations, 18 AAC 75.

Changes for Administration, Corrective Action, Cleanup Levels, Certified Workers, Financial Assistance, Laboratory Approval, and General Provisions.
Modifications were made to 78.960 to reflect amendments to hearing procedures in 18 AAC 15.
Underground Storage Tank Procedures Manual (Dated December 1, 1999)
Underground Storage Tank Regulations (Chapter 78) 18 AAC 78: (Effective August 27, 2000) Please see the Regulations Infobase for detailed information.
Changes were made to 78.600 (d) and (e) in order to
- be consistent with changes in the same requirements found in the CS regulations. The hazard index would be "across all exposure pathways" rather than old language that stated that it would be "for each exposure pathway".
- change name of the "Guidance on Cleanup Levels Standards Equations and Input Parameters" to "Guidance on Cleanup Levels Equations and Input Parameters" in 18 AAC 78.600 (e).

New revisions to the UST Regulations, 18 AAC 78, took effect on April 16, 2000. Changes to the regulations were completed to
- Amended UST third party inspection due dates, 18 AAC 78.017, which includes allowing up to 120 days for inspection.
- References to new drinking water regulations
- Significant changes on eligibility requirements for cleanup assistance, 18 AAC 78.500 - 78.560 as well as changes to general provisions in 18 AAC 78.910 - 78.995 to implement changes enacted by chapter 70, SLA 1999 (Senate Bill 128). The change involved grant and loan eligibility provisions, grant caps, eligible costs, procedural changes, and repeal of regulatory provisions dealing directly to grant eligibility and revised grant caps. In addition, a cleanup loan program, available only to owners and operators currently on the application waiting list, are implemented through the regulation changes.
- UST Procedures Manual Update: revised the Underground Storage Tank Procedures Manual and the regulation that adopts the manual by reference.
Underground Storage Tank Procedures Manual (Effective December 1, 1999)
Changes made to:
- Modified analyte information for Table 1: Reference Guide to Sample Collection and Laboratory Analysis for soils and water. Edited information in the first four columns. Footnotes for Table A and B modified also.
- Changed section 9.1.4 for the number of samples from 10 to 20 to be consistent with Table 4.
Underground Storage Tank Regulations (Chapter 78) 18 AAC 78: (Effective August 24, 1999) Please see the Regulations Infobase for detailed information.
New revisions to the UST Regulations, 18 AAC 78, took effect on August 15, 1999. Changes to the regulations were completed to:
- Added two new sections, 18 AAC 78.506 and 507, dealing with the form for certification of net work for underground storage tank assistance.

New revisions to the UST Regulations, 18 AAC 78, took effect on August 15, 1999. Changes to the regulations were completed to:
- ensure USTs are in compliance with leak prevention requirements though period operations inspections by certified inspectors;
- added a new category of Operations Inspectors to the certified workers program and outline qualifications
- Created a "tag" program so USTs that pass inspection may receive fuel.
Underground Storage Tank Regulations (Chapter 78) 18 AAC 78: (Effective June 25, 1999) Please see the Regulations Infobase for detailed information.
Changes to the regulations were completed to:
- ensure consistency between the UST regulations and the new Contaminated Sites (CS) Regulations, 18 AAC 75, Article 3 regarding cleanup standards for soil and groundwater and corrective action requirements;
- improve the laboratory approval; and
- to update, reorganize, and clarify the UST regulations.
Details on the soil and groundwater cleanup standards and the process for determining site specific cleanup standards can be found in the CS Regulations, 18 AC 75.
Modifications to the UST Procedures Manual have also been made. Changes include:
- An addition of new fractionation methods for aliphatic and aromatic petroleum hydrocarbons, Alaska Series 101AA, 102AA, and 103AA Methods to provide results that can be used with the new standards in the CS regulations;
- Updates to sample collection and laboratory analysis requirements in Table 1;
- Sampling and laboratory analysis for soil and groundwater in Table 2; and
- Additional performance criteria and technical corrections to the Alaska Series 101, 102, and 103 Methods.
