| Permit to Discharge Pollutants into Surface Waters (NPDES) There are no NPDES permit requirements for oil spill response. Per 40 CFR 122.3, an exclusion is provided for NPDES permit requirements during the emergency phase of an oil spill response, for as long as the spill is being managed by an OSC. NPDES permits may be required for post-emergency projects once the UC has stood down. |
| Burning Oily Waste There are no air quality permits for burning of oily waste. Oily wastes may only be burned in an incinerator with the appropriate permits already in place. |
