Permit Responsibilities as Facility Operator

Operators of industrial facilities requiring an APDES Stormwater Permit are eligible to obtain coverage under the MSGP if their activities are included within one of 29 industrial sectors. See Appendix D of the MSGP for a listing of facilities and activities that are covered. (Note that this is only a partial list of your responsibilities and that you must consult the Multi-Sector General Permit for details.)

  1. Determine whether the facility or site discharges to a municipal separate storm sewer system (MS4) or to waters of the United States. If it does not, no permit is required.
  2. Determine if the facility's industrial activities are listed among the eleven Categories of Industrial Activities, provided in the federal regulations at 40 CFR 122.26(b)(14) or if the facility's SIC code falls within one of the sector/subsectors identified in Appendix D of the MSGP or use the SIC and NAICS - Sectors Cross-Reference. If its activities are not listed, no permit is required.
  3. Determine if the listed facility or site may qualify for the "no exposure" exclusion under the federal regulations at 40 CFR 122.26(g)
  4. Develop a stormwater pollution prevention plan (SWPPP). Development and implementation of an industrial SWPPP is the key condition of the MSGP. A SWPPP template is provided for your convenience.
  5. Keep a copy of the permit and all associated records on site during the entire permit period.
  6. Submissions to DEC:
    • Submit an original signed Notice of Intent (NOI) through DEC's online application system EDMS.
    • With a submittal of an NOI pay the General Permit Authorization Fee of $735 (See 18 AAC 72.956 Table D (11)). There is a step during the electronic NOI process where payment is required. This is a fee that has to be paid annually. DEC will bill the facility in subsequent years for the annual fee.
    • Provide a copy of the SWPPP (digital format (PDF) preferred).

Monitoring - Discharge Monitoring Report (DMR)

Permittees are reminded that several sectors require either quarterly benchmark monitoring and/or annual effluent limitation monitoring as detailed in MSGP Permit Part 7.0 (Monitoring) and Part 11 (Sector Specific Requirements). Benchmark monitoring and effluent limit monitoring must be conducted in accordance with MSGP Permit Part 7.1 (Monitoring Procedures) and reported to DEC as required in MSGP Permit Part 9.1 (Required Monitoring Data to DEC).

Permittees must submit DMR data electronically through NetDMR per Phase I of the e-Reporting rule (40 CFR 127) upon the effective date of the Permit. Authorized persons may access permit information by logging into NetDMR Portal.

DMRs submitted in compliance with the e-Reporting Rule are not required to be submitted as described in Appendix A - Standard Conditions unless requested and approved by the Department. Any DMR data required by the Permit that cannot be reported in a NetDMR field shall be included as an attachment to the NetDMR submittal.
