Contamination reported by Baxter Excavating. Note in file by regulated UST staff dated July 15, 1994 states as follows: "Mr. Baxter, Baxter Excavating, was hired by Richard Morrison (the property's previous owner) to remove a heating oil tank. The current owners, Dave and Donna Duke, allowed them on the property to do so. Per Baxter, the sale agreement did not disclose the existence of the tank. Excavation uncovered a 1,000 gallon gasoline tank. Evidence from the next door neighbor suggests that the tank was used to fuel vehicles, both private and commercial. Morrison ran an office of the Morrison and Van Wey Construction company from his home. A 55-gallon drum was also excavated from the area of the tank. It was probably used as a dry well to dump oil, etc. from vehicle maintenance. The neighbor believes that a floor drain in the garage was used to dispose of oil, as well. Because Baxter was unsure of what to do, he lined the excavation and replaced the petroleum contaminated soil He took soil samples and had them analyzed at Northern Test Laboratory. Results indicate 4,100 mg/kg GRO and 21 mg/kg benzene. Baxter has the tank and the drum at his shop. Unless Morrison pays him for the work, he plans to return the items to the Hillside property. I asked him to have the Dukes call me to 'report' contamination on their property. Discussion with staff led to a decision to treat Morrison not the Dukes as responsible party at this time." |

DEC received a written complaint dated 8/18/1994 from neighbor Kent Woodman regarding ongoing excavation on the adjacent lot to the north and stating his concerns regarding his drinking water well, which is about 75 feet from the former tank site. Woodman estimated that 75-100 cubic yards of soil had been removed from the excavation so far. |

ADEC received a letter dated 10/5/1994 from neighbor to adjacent lot south Kent Woodman that follows up a phone call to Bill Lamoreaux of ADEC on 9/23/1994. The letter makes a formal complaint and requests action. Woodman notes that the former owner Morrison sold the 12900 Hillside Drive property in December 1994. Woodman states "This spring, while doing some planting, the present owner discovered a pipe which lead to his discovery of a buried 500 gallon gasoline tank on the extreme south edge of the property, abutting my lot. He went back to the Realtor, who went back to Morrison, who hired Baxter Excavating to dig up '...about 30 cubic yards ...' and refill (the excavation). Baxter began work and hired an environmental firm to do the "sniffing". As they dug, they found that the tank HAD LEAKED. They also dug up a 55 gallon drum of used engine oil, apparently buried by Morrison." According to Woodman the contaminated soil is stockpiled, and the cover is not intact, so that petroleum contaminated soil is spread by wind. Woodman also notes that Morrison and the realtor will not test his drinking water well, about 72 feet from the spill site, as he has requested. |

On 10/26/1994 ADEC received pre-treatment analytical results and a request to transport soil to CleanSoils for thermal treatment dated 10/11/1994. Approval was granted this date. Soil contained 4,100 mg/kg GRO and 21 mg/kg benzene. Analytical results from soil stockpile samples analyzed for VOCs by EPA SW-846 Methods 5030/8010 that exceeded migration to groundwater standards 0.310 mg/kg Tetrachloroethene (PCE) and 26 mg/kg Dichloromethane (aka Methylene Chloride). |

ADEC received data deliverables dated 3/13/1995 from CleanSoils, Inc. documenting the treatment of 177.06 tons of petroleum contaminated soils for which the contaminant was gasoline (transport approval granted on 10/26/1994). Five samples were also analyzed prior to treatment on 8/13/1994 for metals (lead, arsenic, cadmium and chromium) with results below the most stringent concentrations found in 18 AAC 75.341 Soil Cleanup Levels. |

On 4/20/1995 met with current owner Mr. Duke, who provided copies of photos and a copy of a real estate disclosure form which indicates no tanks remaining. This followed a discussion with excavation contractor Jim Baxter who stated he thought a slab was poured over the location of the tank. Baxter also confirmed it was definitely a 1,000 gallon tank. He also observed a drain line from the garage floor to a buried drum that had holes in the bottom. |

Response to ADEC's 4/20/1995 Notice of Violation from Richard Morrison of AGF Construction. Letter states that excavating contractor Jim Baxter removed the underground storage tank and a 55-gallon drum from the property, and that excavated soil was stockpiled on the property. Morrison states he and his wife acquired the property in 1970 from Lyman Woodman and built a home in 1972-1973, with the tank and 55-gallon drum installation taking place in 1977. Morrison states that the drum was never connected to the garage (floor drain) (this conflicts with statements by excavating contractor Jim Baxter during telephone conversation with ADEC staff on 4/20/1995; Baxter said a line from the garage was connected to the drum, and that the drum had holes punched in the bottom), and that the home was sold in November 1993. |
