Problems/Comments

The site was the location of two adjacent auto salvage yard and used parts sales operations, one that began operations by the early 1960s (the former ABC Towing/Adrian Gray site that fronted on Old Seward Highway and 56th Ave.); the other property located adjacent and to the east of the Gray Property had the site name ABC Towing/Carley Property site and reportedly began operating as a salvage yard in the early 1980's. Contamination was first documented by ADEC in 1994 when Contaminated Sites staff observed improper handling of gasoline and other fluids released from automobiles during preparation of salvage vehicles for recycling. The improper handling included piercing of gas tanks with hand tools, resulting in high levels of GRO and BTEX in site soils. Widespread surface contamination was also present as a result of intensive automotive salvage activities on the unpaved properties. Initial PRPs included towing companies (Aurora Towing, City of Anchorage (operation clean sweep)), ABC Towing, and Adrian Gray (Property owner). The ABC Towing/Adrian Gray and ABC Towing/Carley Property sites were considered separate sites until they were administratively combined in 2009 when both properties were purchased as the planned location of a large warehouse. Cleanup complete status with institutional controls (CC-ICs) is in effect for the site as of ADEC's February 19, 2009 decision, with extensive additional environmental work that took place from 2009 through 2016 documented in the March 21, 2018 addendum to the CC-ICs decision.

Work entailed collecting two samples from a septic tank and collecting 12 samples (tested for DRO, GRO and BTEX) from depths of 18 to 30 inches below the ground surface areas identified in previous investigations as having high field-screening readings. 9/24/2003 Record of Decision Carley site (former): The Record of Decision was signed for this site recognizing that elevated levels of soil contamination remain on site but with certain institutional controls - will not pose a risk. The leaching assessment from the Gray property was used in making the decision and requires groundwater monitoring to verify assumptions. Soils were reported as moist for all borings except B-6, for which the 2.3-6 foot interval is described as moist to wet. The locations of the probes were within the boundaries of the proposed easement expansion area within and near the northwest corner of the former Gray site, at the southwest corner of Old Seward Highway and 56th Ave. The purpose of the assessment was to identify potential environmental risks associated with purchasing specific easements associated with planned improvements Wal-Mart might undertake in developing a nearby property. The borings were advanced on November 6-7, 2007 with boring locations based on the reported groundwater flow direction to the north and northwest. All screened intervals were appropriate. Groundwater was encountered in all of the borings and was measured at depths of less than 6 feet below the ground surface after drilling. Peat was not present in 5 of the 6 borings, but was present in boring B4MW as a 1/2 foot-thick stratum 4-4.5 feet below the ground surface. Groundwater analytical results were above 18 AAC 75.345 Table C cleanup levels for B2MW and B4MW with respective contaminant levels of: 2.45 mg/L DRO and 1.94 mg/L RRO; and 18.4 mg/L DRO, 1.29 mg/L RRO, and 0.192 mg/L benzene. Soil contaminant levels were also elevated in these two borings, with the results for the B2MW 6-8 foot sample 395 mg/kg DRO and the results for the B4MW 0-2 foot sample 6,760 mg/kg DRO and 16,300 mg/kg RRO and elevated metals analytical results. 1/7/2008 Offsite Soil or Groundwater Disposal Approved ADEC approved transport and remediation of three 55-gallon drums of investigation-derived wastes (IDW) containing petroleum hydrocarbon, metal, and PCB-impacted soil, and petroleum hydrocarbon-impacted water generated during the soil and groundwater assessment activities at the East 56th Avenue and Old Seward Highway intersection. Work was done by Shannon & Wilson, Inc. on behalf of Wal-Mart, which has property farther to the east that may be developed, in which case the intersection would need to be upgraded. The soil is contained in two 55-gallon drums, and the water is contained in one 55-gallon drum. One 55-gallon drum containing petroleum hydrocarbon, metals, and PCB-impacted soil will be transported to an EPA-approved Class C landfill in Grandview, Iowa. The analytical results were 467 mg/kg lead and 0.501 mg/kg PCBs. A 55-gallon drum of petroleum hydrocarbon-impacted soil containing 395 mg/kg DRO will be transported for disposal at the Hiland Road landfill. A 55-gallon drum of petroleum hydrocarbon-impacted development/purge water was approved for treatment and filtration prior to release to Anchorage Water and Wastewater Utility (AWWU). The water sample, from Monitoring Well MW4, contained 18.4 milligrams per liter (mg/L) DRO, 1.29 mg/L RRO, and 0.192 mg/L benzene. Eileen Olson
2/27/2008 Update or Other Action ADEC letter clarifying ADEC's position on the contamination issues associated with Walmart's recent acquisition of a 1,888 square foot parcel of land at East 56th and Old Seward Highway to be used for a public utility easement. ADEC will expect the owner or the operator (utility company) of the subject parcel to comply with the terms and conditions of the decision document (current or amended versions) and any environmental regulations that govern the management of contaminated media. 5/9/2008 Update or Other Action Gray and Carley sites (former): ADEC letter sent to owner Justin Green requesting a release investigation and notifying him of changed conditions relative to Conditional Closure status at the "ABC Towing/Adrian Gray Property" and "ABC Towing/Floyd Carley Property" contaminated sites. at 5625 Old Seward Highway. The letter states that during assessment work done in 2007 in the northeastern area of the Gray site, groundwater contamination was documented for the first time. Conditional closure for both sites was granted based on the findings of a June 28,2002 Leaching Assessment for the Gray site. The report concluded that soil contamination at the site had not impacted groundwater and would not migrate to groundwater in the future if the sites were paved or capped to prevent infiltration. While the letter does not rescind conditional closure status for the two sites, it states that based on the review of the May 2007 Easement Characterization and December 2007 Soil and Groundwater Assessment reports, prepared by Shannon & Wilson, Inc. on behalf of Wal-Mart, the conclusions of the leaching assessment are no longer considered to be valid. ADEC requested that a plan be submitted by June 30, 2008 for a release investigation of the areas where groundwater contamination was documented during the 2007 work, and a schedule for monitoring groundwater in the existing wells on the adjacent ABC Towing Floyd Carley Property site (Carley site) property and existing wells on the Gray site. 11/21/2008 Update or Other Action DEC received report "Site Characterization, 5625 Old Seward Highway...November 2008" by Shannon & Wilson. June 2008 soil sampling and September 2008 Soil and Groundwater sampling are reported. Four borings designated B02, B03, B04, and B05 were advanced within the building footprint to depths of 11.5 to 17 feet below the ground surface (bgs) during the June 2008 sampling effort. Groundwater was not encountered in any of the four borings. One sample was collected from each boring. The only elevated petroleum hydrocarbon constituent encountered in the four samples was 0.525 mg/kg benzene from the B02 2.5-3.5 foot sample described as silty sandy gravel. The second phase of work was done in September 2008 and entailed completing two borings as monitoring wells, B7MW and B8MW. The screened interval for both newly installed wells was below the measured groundwater level after drilling with static groundwater measured in the monitoring wells at 0.92 foot bgs (Well B7MW) and 3 feet bgs (Well B8MW). 2/19/2009 Update or Other Action DEC issued a Record of Decision granting Closure Complete with Institutional Controls status to the Former Auto Salvage Yards site. The site was created administratively in January 2009 by combining the adjacent former ABC Towing/Adrian Gray and ABC Towing/Floyd Carley sites. The two former sites were conditionally closed by 2004, but subsequent investigation done in anticipation of development identified previously undocumented groundwater contamination that exceeded ADEC cleanup levels. In addition, the planned land use changed from the current vacant status to a proposed building site. The changed knowledge of site conditions and proposed change in land use necessitated modifications to the existing conditions of closure. The four tax parcels comprising the site are expected to be re-platted as one parcel that is the planned location of a 55,000 square foot retail warehouse. In addition to standard requirements such as recording a deed notice that describes the type and extent of contamination remaining at the site, the institutional controls for the site include requirements to 1) install additional monitoring wells; 2) submit for ADEC approval a plan for monitoring the new and existing monitoring wells, 3) submit an environmental management plan to ADEC for review before pre-construction excavation or other activities take place with the plan covering events specific to the construction period such as dewatering of excavations, dust suppression and diverting runoff; and 4) submit a plan for construction of an asphalt or other ground-surface cap if one is proposed as a means to control infiltration. The plan states that the monitoring wells installed in 2008 demonstrate that the groundwater contaminant plume does not migrate off-property from the Adrian Gray parcel. 9/17/2009 Proposed Plan ADEC received "5625 Old Seward Highway, Anchorage, Alaska, 2009 Soil Borings Work Plan" prepared by BGES and proposing to characterize the magnitude of contamination in soils in areas to be excavated for later construction. The plan notes that the static groundwater level in monitoring well G-2 was reported to be 0.67 foot below ground surface (bgs), and 4.80 feet bgs in monitoring well G-1, and these two wells are within the approximate boundaries of the future building pad location. Both G-1 and G-2 were located on the former Carley property. The plan proposes to advance approximately 27 soil borings in the proposed building excavation area to characterize the extent and magnitude of contaminated soils prior to excavation activities, and 23 soil borings will be advanced in the proposed utility trench excavation areas to a depth of 15 feet bgs. It was BGES' understanding that the utility trenches will be excavated to a depth of approximately 12 feet bgs. Boring in the utility trench areas will be advanced to 15 ft bgs. 12/2/2009 Document, Report, or Work plan Review - other ADEC received information on 12/1 and 12/2: The text portion of the BGES "Draft Summary of Soil Borings and Contaminated Soil Volume Calculations Along Planned Utility Corridor and Within Proposed Building Foundation, 5625 Old Seward Highway" prepared by BGES and dated October 30, 2009 was received 12/1/2009. Previous submittal (10/30/2009 database entry) only included diagrams. The report documents 50 borings that apparently had maximum depths of 10 ft. that were made Sept. 22-29, 2009 to determine potential future disposal options for the contaminated soils that will be removed during pre-construction. All samples were collected within the proposed AIH store footprint or the utility corridor route. On 12/2/2009 ADEC received a figure showing boring locations and a summary table showing soil boring analytical results and soil disposal types. The summary table only included samples that exceeded cleanup levels or contained detectable PCBs. BGES noted in the text that MRLs for DRO exceeded cleanup levels for many samples collected in the southern portion of the building footprint so that area may contain contaminated soil in addition to the northern half that contains documented contamination from various samples collected from the ground surface to 10 ft below ground surface. Samples exceeded cleanup levels for DRO, GRO, ethylbenzene, benzene, total xylenes and trichloroethene (TCE). Lead was present in one sample at a concentration of 1,010 mg/kg. PCBs were detected in eight samples at levels an order of magnitude below 1 mg/kg. Eileen Olson

In July 2009 four monitoring wells, B9MW through B12MW were installed and sampled; five previously installed wells were sampled; and six previously installed wells were decommissioned. The water levels after installation of two of the new wells, B9MW and B12MW, were above the screened interval by 0.39 feet and 0.69 feet respectively. Well B5MW was accidentally decommissioned instead of well B6MW, and well B3MW was not sampled as proposed in the approved work plan but will be sampled later. Five of the 9 wells sampled including two of the new wells exceeded the cleanup levels for DRO, RRO and/or benzene. Four of the 9 wells sampled are screened below the water table, including MW-2, which was sampled in July 2009 instead of B2MW. The plan proposes transport of fuel-impacted soil (DRO, GRO, RRO and BTEX) from the site to a site adjacent to the permitted C&D Inert Waste Monofill in Palmer, also owned by Alaska Demolition, to be treated by landspreading. ADEC requested a revised plan that meets the requirements of 18 AAC 75.360, Cleanup operation requirements and 18 AAC 75.365, Offsite or portable treatment facilities. ADEC stated that landspreading without a liner can be proposed, but if it is the revised plan needs to demonstrate that type and concentrations of contaminants present in the soils proposed for landspreading will not leach or migrate resulting in a risk to human health or the environment. 3/22/2010 Document, Report, or Work plan Review - other ADEC preliminary review comments for "Soil Screening and Characterization, March 2010" plan received March 15, 2010 emailed to ChemTrack noting that review is still in process to ensure that all relevant analytical data was included in the BGES summary diagrams which appear to be the basis for the plan. ADEC further notes that the plan is not approved and that ADEC expects to require additional sampling than that proposed in the plan. Approval is granted only to excavate and stockpile soil at the site with the several conditions listed including but not limited to providing the final dimensions of the proposed excavation at the site; establish known reference points at the corners of the excavation through swing-ties or survey methods; stockpile and map the location of excavated soils so that each 50-cubic-yard or less volume of soil can be located after excavation; off-site transport of any excavated soil is not approved; all excavated soil, including the suspected clean soil, must be placed on a liner and covered; all suspected PCB- and lead-contaminated soils as identified on the attached BGES diagram and identified in other file documents must be segregated in separate stockpiles; soils believed to be contaminated only by fuel compounds must also be stockpiled in a separate area; and advise the ADEC project manager of the field schedule so that staff have the opportunity to observe field work. Lastly ADEC noted that review of the landspreading plan (see database entry of 3/4/2010) is not complete and that approval of landspreading as a remedial method at the proposed receiving property is not a certainty, and if allowed, a liner and cover may required. 4/12/2010 Document, Report, or Work plan Review - other Reviewed submittal by ChemTrack titled 'Additional Information for the Proposed Land Spread Site Alaska Demolition LLC, March 2010' received on 3/17/2010. Contacted Solid Waste Program Coordinator Lori Aldrich who was referenced in the submittal as having "indicated that she did not object to the placement of a land spread area in this location pending approval by the ADEC Contaminated Sites project manager." Ms. Alrich responded that she had not seen any plans prior to being contacted by the Contaminated Sites (CS) project manager on this date, and that she did not recall stating any such thing. She noted that ChemTrack had been advised that the idea would need to be cleared with the CS coordinator, then a shighly pecific operations plan would need to be submitted before Solid Waste would comment. Further, CS may approve (or deny) the plan based on 18 AAC 60.200(a)(3 or it may also be exempt from SW approval based on 18 AAC 60.005(d). If the area and volume are larger than the exempted size requirements, the responsible party would need to apply for a treatment facility permit if required by CS. Eileen Olson
5/5/2010 Meeting or Teleconference Held Brief meeting with Steve Agni and Chuck Waddell, developers, and submittal of "Former Auto Salvage Yards Lead Soil Sample Results" for work done by ChemTrack without a plan to obtain information on lead concentrations in soil, in an area previously documented during April 2009 work by BGES as having 1,010 mg/kg lead within the 0-2 ft. depth interval. ChemTrack collected two samples for lead analysis on April 5, 2010 (date as per lab sheets) from depths of 0.6 ft below ground surface in the area of the previous elevated sample, with results below 10 mg/kg lead. ChemTrack also excavated 30 cy from the area that was sampled and stockpiled the soil on site. Eileen Olson
5/17/2010 Document, Report, or Work plan Review - other ADEC received notification from consultant ChemTrack that excavating at the site would begin on Tuesday May 18, 2010. In response to the email on the same date, ADEC clarified that all of the soil at the Former Auto Salvage Yards site is considered to be potentially contaminated and does not approve the transport of any soil off-site until field screening and sampling results are submitted. ADEC will consider approval of off-site transport of soil following review of the data. ADEC also noted that since there is still an outstanding proposal to transport soil to a location in Palmer, it is important that soil that the record of investigation for the site indicates will be clean is properly segregated as ADEC will not be able to approve transport to the proposed Palmer site of any material that has not met the most stringent cleanup levels until the community input and notification issues are addressed. ADEC further stated that if ChemTrack, acting for Alaska Demolition, intends to pursue landspreading at the Palmer site it will need to contact the City of Palmer to find out what their restrictions are, and go through the public process since the land use at the proposed site has been controversial and there are many interested parties. results. The "Initial Excavation SAP Report, June 2010" was submitted for the first time as an attachment to the EMP and documents work done without submittal of a work plan that included excavating, sampling and stockpiling 300 cy of soil, with samples collected on May 20, 2010. Review by the ADEC CS chemist included the suggestion that a method such as PetroFlag may be more appropriate for field screening gravel especially if it is heavily weathered petroleum and noting that peat is a problem with any field screening or analytical method. The CS chemist also noted that the SAP report only presents the silica gel cleanup results for the samples and does not provide the chromatograms and that chromatograms must be submitted. The field screening criteria to determine 'clean' material was not found to be valid, as a PID field screening reading of <100 ppm should not be considered clean, nor should visual/olfactory screening of peat be used to determine whether soil is ‘clean’. 7/16/2010 Document, Report, or Work plan Review - other ADEC initial review of "Peat Stockpile Sampling and Analysis" report dated July 14, 2010. ADEC requested additional information in an email to involved parties (ChemTrack, AIH, AlaskaDemo). Approximately 3,000 cy of soil was sampled. ADEC noted that the report only presents the silica gel cleanup results for the samples and does not provide the chromatograms, which is not consistent with ADEC technical memo data reporting requirements. ADEC cannot accept silica gel results without further documentation/evaluation, therefore chromatograms were requested. Additionally, the lab checklist submitted is not filled out correctly; the peat samples were not submerged with methanol in the field; the Anchorage lab added methanol to samples E-H and “H” had to be re-extracted at the Portland lab. The checklist marks “yes” for everything and says all data is usable. At a minimum, the GRO/BTEX results for samples E, F, and G should be flagged as low-biased estimates and H should be rejected. Additionally, this elevates the benzene reporting limits above the cleanup level which is incorrect on the checklist. Eileen Olson

8/4/2010 Document, Report, or Work plan Review - other ADEC provided final review comments by email for the "Peat Stockpile Sampling and Analysis Report" received 7/14/2010 and prepared by ChemTrack. The report provides both DRO and post-silica gel cleanup DRO results for approximately 3,000 cubic yards of excavated and stockpiled peat. ADEC's preliminary review comments on 7/16/2010 requested chromatograms for the laboratory analysis of the peat, field notes and laboratory QA/QC checklists in accordance with applicable ADEC guidance documents. Following receipt of the requested data by 7/21/2010 ADEC provided review comments in an email dated 8/4/2010, noting that the applicable site cleanup level for DRO is 250 mg/kg (rather than 230), so several samples that exceeded 230 mg/kg DRO but did not exceed 250 mg/kg can be considered to meet Method Two cleanup levels for the Anchorage precipitation zone. Additionally, review of the chromatograms for one sample that exceeded the DRO cleanup level indicated that all compounds detected were biogenic, so the sample was considered to be below the applicable cleanup level for DRO. 8/9/2010 Meeting or Teleconference Held Staff Rich Sundet and project manager met with Chuck Ronan of ChemTrack, Inc. and Steve Agni of Development Managers, Inc. Discussed during the meeting was the fact that DEC has not yet approved ChemTrack’s workplan received July 13th. ADEC also learned during the meeting that work proposed in the plan including the backfilling of contaminated soil at depth within the building footprint excavation was done without ChemTrack’s knowledge or oversight. ADEC noted in a followup email to Mssrs. Ronan and Agni that DEC regulations at 18 AAC 75.355 require that a responsible person ensure that the collection, interpretation, and reporting of data, and the required sampling and analysis is conducted or supervised by a qualified, impartial third party. Staff noted that a review letter will be forthcoming upon receipt of information requested in the ADEC project manager's email of August 5, 2010, and to refrain from working without direct oversight of a qualified third party and refrain from placing contaminated or potentially contaminated soil back in the excavation until plan review is complete. 8/19/2010 Site Visit A second site visit was made by ADEC staff member, Brent Porter to discuss two issues identified by Rich Sundet and Eileen Olson. The first issue discussed with Mr. Ronan was the need to have an ADEC qualified person onsite directing the site environmental work. The second issue discussed with Ronan was the movement of contaminated soil without an approved work plan. 8/19/2010 Update or Other Action ADEC email to ChemTrack regarding request to use soil excavated prior to receipt of DEC's August 13th letter as backfill. ADEC requested field notes for all excavated soil proposed for use as backfill, a table showing the total estimated volume of non-peat soil excavated to date, the dates it was excavated, and the status of the fill (that is, the volume that has been used as fill, and the volume of soil remaining in stockpiles that is proposed for use as fill in the excavation). If all of the soil to be used as fill has not been field screened at one sample per 10 cubic yard; for example if the uppermost layer of sand and gravel was not field screened during excavation it will need to be field screened before being used as fill. The placement of fill should be documented in field notes during work, including the maximum depth below the surface of the bottom of the fill layer, the thickness of the re-used fill placed in the excavation, and the location of the clean fill buffer zone. 9/2/2010 Site Visit Staff visited the site during compaction of backfill and met onsite with consultant ChemTrack. Staff noted dewatering of excavation in progess from the excavation into a drainage ditch and lack of liner or cover for potentially contaminated stockpiles. 9/28/2010 Update or Other Action Consultant ChemTrack submitted by email analytical data and chromatograms for peat samples from stockpile designated 'K' collected on 9/16/2010. Stockpile K contained an estimated 375 CY and was sampled at a rate of 1 sample per 25 CY, for a total of 15 samples collected for DRO analysis, with silica gel (SG) cleanup conducted on (& chromatograms provided for) samples that exceeded the 250 mg/kg cleanup level for DRO under method 2, less than 40 inch precipitation zone, of 18 AAC 75.341 (Soil cleanup levels; tables). Following SG cleanup all of the samples were below the 250 mg/kg DRO cleanup level, ranging from 112 to 231 mg/kg DRO. ChemTrack noted in a separate email that the excavation for the building is finished with backfilling still in progress using imported fill. ChemTrack also reported that no sand/gravel has been transported from the site and only the peat that was specifically approved for removal has been transported off-site. Eileen Olson

Thirteen of 20 samples contained less than 250 mg/kg DRO without using silica gel cleanup. Based on a review of chromatograms by ADEC chemist Earl Crapps, ADEC determined that the chromatograms received on 9-30-2010 for the sampling on 9/27/2010 showed the material was peat with very low levels of anthropogenic contaminants present, and placed no restriction on the movement or placement of that soil (i.e. Stockpile K, estimated at 375 CY). For soil showing the presence of diesel but at levels below the 250 mg/kg cleanup level for DRO (i.e. Stockpile BP, estimated at 500 CY), the soil placement is restricted to areas at least 100 feet from any area that is sensitive such as a wetland or within the protective radius of a drinking water supply system such as a Class A well. 10/26/2010 Update or Other Action ADEC received a final report "LEGACY STOCKPILE SAND/GRAVEL Sample Analytical Data, October 2010" via email from ChemTrack for sampling sand/gravel fill material referred to as the legacy stockpile. The pile was demarcated into 98 grids that were sampled. The 'legacy stockpile' included intermixed peat. The narrative states the following: During the site excavation the sand/gravel fill material was separated from the peat material. Both the peat and he sand/gravel fill material were field-screened to evaluate potential contamination. Sand/gravel fill that had no sheen, no odor and had a PID measurement of 2 units or less was staged separately for potential re-use as on-site backfill material. This sand/gravel stockpile has been designated the "Legacy Stockpile". Please note that sand/gravel fill material that did have an odor/sheen and/or PID measurement >2 units was staged in a different area. 11/18/2010 Offsite Soil or Groundwater Disposal Approved ADEC conditionally approved transport of ~2,500 cy of gravel containing less than 250 mg/kg DRO to the private Green property designated in 10/8/2010 correspondence with the following conditions: 1) The placement and depth of the fill transported from the Former Auto Salvage Yards site will be located on a to-scale diagram of the receiving property so that ADEC may verify a separation distance of at least 100 feet from surface water bodies, including the pond shown on the site plan that has yet to be excavated. 2) All solid waste will be removed from the fill upon unloading and spreading/placement at the receiving property. 3) Approval is granted only for material that was sampled according to the requirements of ADEC’s letter dated August 13, 2010, for which analytical results were provided to ADEC, and for which DRO concentrations were either below 250 mg/kg DRO, or for which ADEC explicitly approved any analytical results for DRO that exceeded the 250 mg/kg cleanup level that were subsequently reduced based on the presence of biogenic compounds as determined by a review of the chromatograms. 4) ADEC staff will be allowed access to the receiving property during and after placement of the soil as appropriate for general oversight functions and/or to verify the placement of soil with respect to existing or planned surface water bodies. 5) ADEC may issue these conditions in greater detail and reserves the right to require additional recordkeeping and documenting than that provided in this email. Peat and coarse-grained soil (sand and gravel) were excavated and segregated, with an estimated 270 cubic yards (CY) of peat excavated and 480 CY of coarse-grained soil excavated. The utility corridor is located in the northern central section of the site, just south of E. 56th Avenue. The peat was screened and sampled and the lab conducted silica gel cleanup on samples to demonstrate that there is a biogenic component to the results in the diesel range organics range (DRO) and that the analytical results are therefore below the applicable cleanup level for DRO. The email notes that excavation of soil and installation of a storm drain system is in progress and that sand/gravel material with less than 250 mg/kg DRO will be used as fill at this site or at another location, and excavated material with DRO levels above 250 mg/kg will be disposed of at the MOA ARL landfill. ChemTrack states that clean material will be moved as necessary to allow for continued site excavation. The material that exceeded 250 mg/Kg will be kept onsite pending approval for disposal from the Municipal Landfill and submission of that approval to ADEC with a request to transport the soil. Soil data was received and reviewed on 8/25/2011. Disposal at ARL was approved for 22 stockpiles (223, 225, 226, 229-232, 367, 370, 371, 373-375, 378, 382, 383, 385, 386, 391, 392, 395, 400) containing DRO ranging from 283 - 822 mg/kg. Thermal treatment at ASR was approved for 4 stockpiles (372, 396, 398, 401) containing DRO concentrations ranging from 870 to 1040 mg/kg. 11/9/2015 Document, Report, or Work plan Review - other ADEC review letter requesting a groundwater monitoring schedule issued for the BGES report "SITE CHARACTERIZATION ACTIVITIES, May 2015" for work done according to the plan approved 4/2/2015. Work included advancing four soil borings with three finished as monitoring wells MW1A, MW2A and MW3A in April 2015. One soil sample was collected from each boring with analysis for DRO, RRO and BTEX. Soil samples from borings SB1 and SB2, completed as MW1A and MW2A, exceeded the benzene cleanup level (migration to groundwater) of 0.022 with respective results of 0.0529 and 0.303 mg/kg. Monitoring well MW2A was the only well that exceeded contaminant concentrations for any compound, with a result of 0.0108 mg/L benzene compared to the groundwater cleanup level of 0.0046 mg/L. ADEC's letter noted that although the site has retained cleanup complete with institutional controls status, following completion of monitoring and other environmental work that may be required, ADEC expects to issue an addendum to the February 19, 2009 decision document. The addendum will update the decision document by summarizing environmental work done at the site since the decision document was issued, including providing updated information on land use, the conceptual site model (CSM) and contaminant distribution. 12/15/2015 Update or Other Action ADEC issued a conditional approval letter dated 12/15/2015 for a workplan received on 12/14/2015 for groundwater monitoring prepared by Geosyntec Consultants Inc. Conditions included collecting groundwater monitoring water samples as close as possible to, and within one foot of the soil/groundwater interface (i.e. water table) and recording the depth of the end of the tubing. As noted on page 29 of ADEC’s Draft Field Sampling Guidance, May 2010 the guidance, groundwater samples must be collected as close as possible to the soil/groundwater interface. Eileen Olson

MWA1 contained o-Xylene at a concentration of 0.330J mg/L, exceeding the 2016 groundwater cleanup level that had not yet gone into effect as of the date of the report. 4/12/2016 Update or Other Action ADEC received a revised report by ChemTrack as requested in review letter dated 11/06/2015: "Project Summary Report, Former Auto Salvage Yards...Revised April 2016." Information requested in the letter has been provided in part but new data is included that appears to have no basis in the file record. Determination is that ADEC cannot rely on the information presented in ChemTrack's report as accurate in several respects including the locations where the soil (consisting of peat, sand/gravel and mixtures of peat and mineral soils) was taken, or which type of soil was transported. ADEC did not, for example, approve transport of any soil to landscaping firms as the criteria set forth for soil that contains anthropogenic DRO could not be assured in a commercial setting (examples - such soil cannot be placed within 100 ft of streams or within the protective radius of a drinking water supply system such as a Class A well.) and no record of such transport was included in the earlier August 2015 summary report received 8/8/2015. The subject 2016 report includes in Table 3, 'Soil Disposition' that 17,123 tons or 12,684 cy of soil was taken to Alaska Trailblazing for landscaping and clean fill on a single day, 9/15/2010, but provides no invoices or other records, all previously requested by ADEC, of such transport. Additionally, ADEC approved transport of 3,375 cy of soil to the Justin Green property, while the ChemTrack reports indicate that only 300 cy were transported to that location. The total tonnage of excavated material transported from the site increased from 22,350 tons as reported in the 2015 summary report to 39,424 tons as reported in the 2016 summary report. In conclusion the record of the transport and fate of the soil excavated at the site is incomplete and/or contradictory. Eileen Olson
