Submitted letter requesting that the responsible party respond in writing within thirty (30) days from the date of the letter providing a historical account of the actions he has taken to address the contamination on his property from spills of petroleum derived liquids such as fuels, lubricants, and/or oils. ADEC has reviewed the file regarding the contamination found on- site and found very little information that would provide an estimate of the nature and extent of contamination. |

DEC issued a letter on July 12, 2007, requesting that Mr. Leonard respond in writing to this office by August 31, 2007 discussing, to his knowledge, past site investigation activities on his property. As part of this written response, DEC requests that Mr. Leonard identify who did the work and their associated experience and training characterizing or cleaning up contaminated sites.

DEC staff is planning a trip to Egegik and would like to meet with Mr. Leonard to discuss the cleanup process. The Deadline for Mr. Leonard to respond is August 8, 2008. |

DEC staff was notified on August 24th that Lee Leonard refused to review DEC's July 30th letter. During the week of August 18th, DEC staff visited the village of Egegik in order to meet with Mr. Leonard; however, Mr. Leonard refused to meet with DEC without his attorney present. |

DEC has reviewed a letter from Brian J. Stibitz, dated December 31, 2008. Mr. Stibitz is Lee Leonard's attorney and explained in his letter that Mr. Leonard will conduct a site characterization during the summer of 2009. |

DEC issued a letter to Brian Stibitz, requesting he confirm that Mr. Leonard’s estate does not have sufficient funds or assets that could be liquidated to conduct a site investigation. DEC was informed in August of this year that Mr. Leonard passed away last December. DEC informed Mr. Stibitz that an investigation would likely cost anywhere from $20,000 to $60,000. DEC also requested that Mr. Stibiz forward an attached limited liability form to the executor of the his estate for their signature. This form must be signed in the event that DEC chooses to move forward with a state led investigation and/or cleanup. |

DEC staff was informed that the City of Egegik (City) has requested approval form the Regulatory Commision of Alaska (RCA) to purchase Egegik Light and Power overhead distribution system, together with all associated lines, transformers, poles supports for poles and connections; underground distribution system, together with all associated lines, transformer, and connections. The City's requested approval from the RCA in order to become the de facto electrical power utility provider for the community. DEC staff reviewed the City of Egegik's application and informed them and the RCA via a March 30, 2011 letter that they may be liable for any contamination associated with contaminant spills due to line failures and/or surface spills from leaking on-site transformers. In addition, both parties were informed that DEC may conduct a state led investigation with eventual goal of cleaning up the site. If the City of Egegik is determined to be a liable party through these investigations, DEC may attempt to cost recover for cleanup and/or DEC oversight of cleanup. |

DEC issued a letter to Don Strand, Egegik City Administrator and Richard Deigh, Mayor of the City of Egegik responding to their March 31, 2011 letter requesting the Department clarify its position with regard to the City's attempts to purchase the transmission lines form Egegik Light & Power. DEC informed both individuals it has no plans to pursue immediate legal action as a consequence of the transfer of the utility certificate since we are not aware of any contamination associated with the transmission lines. We also notified both individuals that while we cannot waive liabilty under AS 46.03.822, are foremost consideration is to ensure the residents of Egegik are provided electricty. |

Staff discussed the status of the site with Don Strand. Don informed staff that the city of Egegik has recieved the certificate from RCA to operate as the power company. The city has been generating power since last fall at which time they connected to the former Light and Power Utility lines but left the Egegik Light and Power Generators and other equipment on the late Mr. Leonard's property. To his knowledge, no environmental investigations have been conducted to date. |

Notice of Environmental Contamination recorded for the Egegik Light and Power contaminated site. The NEC remains in effect until a written determination from ADEC is recorded that states that soil and groundwater at the site have been shown to meet the most stringent cleanup levels in 18 AAC 75 and that off-site transportation of soil is not a concern. |
