Problems/Comments

When underground storage tanks (USTs) were removed and contamination was detected, Alaska Industrial Development and Export Authority (AIDEA) was a lienholder on this property. Somewhere between the time that ADEC requested a Corrective Action Plan (CAP) in order to complete assessment and cleanup of remaining contamination, AIDEA sold the property. The new owners insist that they were never informed of the remaining contamination prior to purchase, while AIDEA insists that they disclosed this fact before the property sale. Warning letters were sent to both parties and ADEC has been given the legal opinion from the Alaska Department of Law, that AIDEA is not a responsible party (liable) for the remaining contamination issues at this site. ADEC would have to pursue the current land owners (who may pursue a cival legal action against AIDEA). The ADEC Drinking Water Program was notified of low levels of benzene, toluene, ethylbenzene, and xylenes (BTEX) contamination that were verbally reported to have been detected in the domestic drinking water well serving this property. Project is currently inactive because the landowners have been non-responsive to ADEC requests for groundwater sampling and analysis on both the drinking water well, and the 4 groundwater monitoring wells that were installed at this site.

1/14/2003 Update or Other Action In June 2000, the Department of Law determined that AIDEA was not legally responsible for the environmental contamination at this site. ADEC is no longer pursuing AIDEA for site cleanup. Soil and groundwater contamination remain in the area of the former dispensor islands. Mr. Denny passed prior to November, 1994. No assessment or cleanup has been funded by the prior land owner and service station owner/operator - Clifford Judkins, or by the current land owner, Jackie Denny. 9/22/2014 Update or Other Action Four groundwater monitoring wells remain at this site, based on the last information known to ADEC. The RP refused to fund the sampling and analysis of the GW MWs. 2/24/2015 Update or Other Action Property owners (Don & Jackie Denny) are reported to both be deceased, according to realtor Todd Peterson from Seward Real Estate Company. Estate (children of property owners) are seeking to sell property. ADEC contacted by Todd Petersen, Seward Real Estate, requesting ADEC determination on any remaining work required to obtain a Cleanup Complete decision. ADEC requiring that MWs be sampled, and a sampling report filed with ADEC. If water quality acceptable, MWs must then be properly decommissioned.
