Per Alleva and his consultant, this is already in writing, but there is nothing in the Department's file to indicate such a letter was prepared or sent. 12/19/2006 Conditional Closure Approved The LeFever Property has been impacted from past releases of petroleum hydrocarbons and cleanup efforts appear to have been effective in reducing the contaminant concentrations over time. However, soil and groundwater contamination remains above the 18 AAC 75 cleanup levels established for the site. The exposure and migration pathways were evaluated and ADEC determined that there is no unacceptable risks to human health or the environment, provided conditions are attached to the property. Based on the information presented to date, ADEC has determined that the LeFever Property is eligible for conditional closure. Todd Blessing
12/19/2006 Institutional Control Record Established Any proposal to excavate or transport soil or groundwater from this property requires DEC approval in accordance with 18 AAC 78.274(b); groundwater use at the site is prohibited unless DEC otherwise reviews and approves its use; groundwater shall be monitored in accordance with 18 AAC 75.345(h) to ensure contamination is decreasing; a Notice of Environmental Contamination documenting the nature and extent of contamination remaining on site and any restrictions and/or conditions necessary to protect human health and the environment shall be recorded in the State of Alaska Recorder’s Office. 5/14/2007 Update or Other Action DEC was recently notified by Ron Alleva that construction and/or excavation activities were being conducted on the subject properties. On May 7, 2007, DEC inspected the subject properties with Brett von Gemmingen and Walt Hand. DEC noted at this time, that brush, shrubs, and trash had been removed, and soil spread at a depth of approximately 1 foot on the surface of Lot 3 and to a limited extent on the surface of Lot 4. The remediation system was still intact. Mr. von Gemmingen informed DEC that the soil used to level Lot 3 and Lot 4 was deposited by various construction companies, one of which was hired by Marlow Manor Downtown, LLC, during the MacKay Building renovation. Mr. von Gemmingen elaborated further that Mr. Alleva facilitated the dumping of soil on the subject properties and that this activity precipitated a lawsuit. In order for DEC to confirm that the soil spread on Lots 3 and 4 did not come from a contaminated areas, DEC requests that Ms. LeFever or her attorney identify where the soil recently spread on the subject properties was originally located. DEC also requests that Ms. LeFever or her attorney confirm that the soil deposited on Lots 3 and 4 is not contaminated and/or hazardous in accordance with state and federal regulations. DEC requested a response, in writing, to this request by May 31, 2007. In addition, DEC requested that Ms. LeFever issue a remediation system decommissioning work plan when and if underground piping or wells are decommissioned. Todd Blessing
5/17/2007 Update or Other Action DEC issued an email to Cindy LeFever on May 17, 2007 in order to comment on the recent observation that underground piping or remediation wells were exposed. At this time, DEC requests that Ms. LeFever provide some sort of fencing or barrier around the exposed underground piping and/or remediation wells. The fencing should, at a minimum, identify and restrict access to the areas where underground piping or remediation wells may pose a preferential pathway to the subsurface or pose a public heath or safety hazard. The fencing or barrier will be required until the underground piping and remediation wells are decommissioned in accordance with a DEC approved work plan. Todd Blessing
5/29/2007 Update or Other Action Reviewed and conditionally approved work plan prepared by Discovery Drilling to decommission remediation system. Discovery Drilling proposed to dig in the vicinity of vertical piping clusters to a depth of the junction with the horizontal piping. The vertical sections of piping would be removed and a silicone or similar plug will be placed in the exposed ends of the horizontal pipes, which will be left in place. Excavations will be backfilled with native materials. Should gross contamination be discovered, Discovery Drilling personnel would document the contamination and store it on-site in a supersack. DEC approves of the work plan provided no soil shall be removed off-site and the decommissioning of air sparge wells will be conducted in accordance with DEC's Recommended Practices for Well Decommissioning. 6/11/2007 Update or Other Action A groundwater monitoring plan was prepared by Cook Inlet Environmental and received on May 31, 2007. Within the work plan, Cook Inlet Environmental proposes to annually collect groundwater samples from monitor wells MW-11, MW-12, and MW-13. Groundwater samples will be submitted to SGS Environmental Services to be analyzed for gasoline range organics, diesel range organics, benzene, toluene, ethylbenzene, and xylenes. At this time, DEC approves of the Work Plan as written provided that Cook Inlet Environmental Inc. does the following: 1. Completes a data review CSP checklist for each laboratory data deliverable received. 2. Delivers a final report to CSP within 60 days following completion of field work. Todd Blessing
6/11/2007 Update or Other Action DEC reviewed a letter from Brett Von Gemmingen. The letter was recieved on May 21, 2007. Mr. von Gemmingen stated in the letter that to the best of his knowledge none of the soil dumped on lot 3 and recently spread on lots 3 and 4 is contaminated or hazardous in accordance with state and federal regulations. DEC reviewed the attached documents and found that the dumped soil was from the following locations: Alaska Sand and Gravel (Sand Lake), former McKay Building, 5 & M Condo Development, Senior Housing Project at Hoyt and Debarr, and subase of 36th Avenue. DEC has reviewed these locations and not found any indication, at this time, that the dumped soil poses a threat to human health and the environment. Todd Blessing
12/13/2007 Update or Other Action Contaminated sites staff reviewed a 2007 Groundwater Monitoring Report. Groundwater samples were collected from three monitor wells (MW11, MW12, and MW13) and analyzed for contaminants of concern. The levels of dissolved GRO, DRO, and BTEX appear to have stabilized at this time. Todd Blessing
11/12/2008 Update or Other Action DEC staff evaluated Cook Inlet Environmental's (CIE's) "2008 Groundwater Monitoring Report", dated October 27, 2008. CIE documented the sampling and analysis of four wells (VES-6, MW-11, MW-12,and MW-13). These wells were gauged with an electronic water level indicator and optical oil/water interface probe. Additionally, the wells were purged with disposable bailers and then sampled to be analyzed for GRO, DRO, and BTEX. Groundwater GRO and DRO concentrations still exceed cleanup levels; however, benzene concentrations were below cleanup levels. Todd Blessing
