UST report received and reviewed. Errors during sampling (no solids jar provided) make all the results suspect (biased low). However, some soil samples were above cleanup levels for GRO and benzene, therefore additional site characterization to determine the extent of the contamination and the impact to groundwater is needed. Letter sent to Petro Star indicating that the site has been added to the CS database and that site characterization is required. |

DEC approved the amendment to the work plan for the release investigation work that began earlier this summer. Lab data was submitted for the samples collected from the first set of soil borings. Data indicates that some soil contamination in the smear zone and groundwater contamination are present. EDB samples for groundwater were analyzed using an inadequate method. The next round of groundwater samples will be analyzed for EDB using method 8011. No soil samples will be collected for EDB analysis at this time.
Source area well installation, which will be completed at a later date, will include sample collection and analysis for EDB in soil and groundwater. |

DEC reviewed and approved the final version of the Monitoring Well Installation Work Plan for the installation of permanent monitoring wells at the source area and downgradient property (former Burger King). Travis/Peterson plans to install 4 permanent monitoring wells and collect soil samples during installation. Field work is tentatively scheduled for the summer 2012. |

DEC received and reviewed the additional Release Investigation Report from TPECI. Contamination with benzene above cleanup levels was detected in a monitoring well on the former Burger King property. The contamination seems to be confined to the property since wells installed on the edge of the Burger King property had benzene concentrations below cleanup levels. However, information regarding groundwater flow and direction is speculative since wells were not surveyed and gradient and direction were not calculated as stated in the work plan. DEC requested monitoring and surveying of the wells for determination of groundwater flow and direction. |

DEC met with Petro Star to discuss several sites. According to the most recent reports, contamination concentrations have decreased since the initial sampling event. Additional monitoring will be performed in fall of 2014 and annual monitoring may be proposed following these results. DEC project manager suggested an evaluation of seasonal shifts in groundwater gradient or elevation before making further decisions at this site. |

DEC replied to PetroStar regarding the request to cease sampling in wells other than MW-2 and decrease the analyte list to benzene only for this well. DEC granted the reduction in analytes because of the lack of detections above cleanup level for all contaminants except benzene, and granted termination of sampling in monitoring wells MW-1 and MW-3. MW-4 will be retained in the sampling program as a downgradient sentinel well. |

DEC reviewed, provided comments to, and approved the 2016 Annual Groundwater Monitoring report. The report documents the detection of benzene in an off-property well downgradient of the source area. The detection was below established cleanup levels. The report recommended additional monitoring to confirm decreasing trends in contaminant concentrations. |

Cleanup Complete Determination Issued |
DEC has issued a cleanup complete determination. Multi-year groundwater monitoring demonstrate that contaminants are now below approved cleanup levels. Residual soil contamination is limited in extent and is 12 - 16 feet below the ground surface. Remaining contamination is not expected to affect future buildings. |
