Problems/Comments
In August 2006 Coast Guard Sitka alerted DEC that oil was observed as a large sheen on St. James Bay in Sitka emanating from an upland source. DEC tracked the surface flow path of the oil to 123 Riggs Road. The source of the release was determined to be from a buried tank supplying heating oil to the residence at 115 Anna Drive. In 2012 the owner removed the buried tank and the contaminated soil which was transported for remediation off-site.

The interim investigation work plan agreed upon between Mr. Kilkeary and his environmental consultant, Elijah Donat with Chilkat Environmental, is a stepwise approach to initially to determine if removal of contaminated soil at the buried tank was necessary or would determining the extent of contamination be sufficient. After visiting the site it is clear that the controlling exposure pathway for this site with the highest risk to human health is petroleum vapor reaching indoor air of the Anna Drive residence. 7/5/2012 | Site Visit | DEC interviewed the resident of the household at 123 Riggs Road who reported the oil spill. The Riggs Road residence and the Anna Drive residence are adjacent properties and both were affected by the historical heating oil release in 2006. DEC determined that the PVC piping from the Anna Drive foundation French Drain system that directs subsurface water effluent onto the Riggs Road residence property is, in all likelihood, a conduit for residual petroleum contamination from the buried tank site. The owner of the Riggs Road property has requested that this piping be removed. The piping can be redirected along the utility corridor to Sawmill Creek Road or plugged. Site Investigation of the drainage on the Riggs Road property is necessary to determine the extent of contamination in accordance with regulation. Field screening of soil and inspection has been requested. Any future soil removal on the Riggs Road is unlikely and is at the discretion of the owner. | Bruce Wanstall |

Chilkat Environmental Inc. (CEI) completed the report documenting remedial site activities at the referenced site. Based on the information provided in the Report, the DEC concurs with the conclusions and will deliberate on the Report recommendations for site closure without institutional controls. 10/29/2012 | Exposure Tracking Model Ranking | A new updated ranking with ETM has been completed for source area 78832 Underground HHOT. An excess water drainage system for the building foundation was located under the buried HHOT and transmitted most of the heating oil to surface drainages in 2006. No trace is found in the drainages now due to freezing temperature conditions during the release. Following removal of 12 tons of contaminated soil and the buried HHOT a de minimis volume of soil contamination remains in the subsurface above human health levels located below the foundation wall. Future excavation is not planned, soil vapor readings were negative and the residence is on a concrete slab. | Bruce Wanstall |
11/2/2012 | Cleanup Complete Determination Issued | The remedial cleanup actions to date have served to adequately excavate and remove contaminated soil from the site. The highest level of contamination remaining in soil was detected in sample south-3 collected under the porch foundation at the bottom of the south wall of the excavation. The DEC has determined that the contaminant levels remaining on site do not pose an unacceptable risk to human health or the environment. Although a Cleanup Complete determination has been granted, DEC approval is required for off-site soil disposal in accordance with 18 AAC 75.325(i) and movement or use of potentially contaminated soil in a manner that results in a violation of 18 AAC 70 water quality standards is unlawful. This determination is in accordance with 18 AAC 75.380(d) and does not preclude DEC from requiring additional assessment and/or cleanup action if future information indicates that this site may pose an unacceptable risk to human health or the environment. | Bruce Wanstall |
