DEC letter was sent certified by regular mail to Ronald and Donna Stout the owner/operator of the Site in Ward Cove requesting a plan be submitted for approval that will schedule soil and groundwater investigation of contamination on the property. The objective of requesting Site Investigation by an environmental professional is to ensure that the pollution is contained and that the migration of contamination is not presenting a risk of exposure that could affect human health and safety or the environment. |

DEC approved by letter sent, by regular mail to the Stout Family Trust and, by email to Shannon & Wilson copied to GCI, Work Plan For Soil Removal Action, Former Ward Cove Car Crusher Site, Ketchikan, Alaska (Plan), dated February 1, 2016. Shannon & Wilson (S&W) submitted the Plan on behalf of Alaska Wireless Network, LLC to prepare a 400 square foot area on the property for installation of a communications tower. The Plan is consistent with regulation and recommendations for data quality assurance and field sampling methodology in Contaminated Sites Program guidance documents. Therefore the Plan is approved in accordance with 18 AAC 75.335(b) with the following comments and requests: New Horizons Telecom Inc. may cross areas of the property not assessed for contamination in order to access the construction site. Field screen sampling may be necessary to ensure site controls are effective. Requested the site work be scheduled to allow the DEC project manager to be present to assist with the removal action. Attachments to the email included a signed copy of the Plan approval letter and a DEC Transport, Treatment, and Disposal Approval Form for Contaminated Media.

DEC met with a representative of the Stout Family Trust, Shannon & Wilson Inc. (S&W), General Communications Inc. (GCI), and New Horizons Telecom Inc.(NHTI), at the site in Ward Cove to observe the removal of contaminated soil in preparation for construction of a wireless phone tower on the property/Site. A volume estimated at 20 cubic yards of soil, contaminated with elevated concentrations of diesel range hydrocarbons, was loaded into super sacks for transport to a licensed off-site treatment facility. Groundwater was not encountered and field screen photoionization detector readings on soil samples indicated clean soil at depths of two feet below ground surface. DEC requested Katie Nolan (S&W) collect laboratory confirmation samples from soil at this depth in the excavation. |

DEC letter sent today to the Stouts gave notice that although a cleanup removal of contaminated soil from Lot 10 Block 3 New Wacker Township by GCI Wireless LLC has been completed, the remainder of the property where the Stouts have operated as Southeast Car Crushers requires investigation for contamination. The standard notification that they were sent by the department indicating your liability for any contamination identified at the Site is still in effect. Because the Stouts are documented as the current owner and operator of this site, they are identified to be financially responsible or liable under AS 46.03.822 (Strict Liability for the Release of Hazardous Substances) for the investigation and cleanup of any hazardous substance contamination that might be present on the remainder of the property. |

Spoke to the landowner - the property has been cleared of vehicles and debris and Mr. Poole has removed potentially petroleum contaminated soil and placed it in a temporary stockpile - we have no report for this. I would like to do a site visit to the property and meet discuss steps moving forward. The soil will most likely have to be tested by an environmental professional. |
