On August 20, 1998 a 2,000 gallon gasoline UST and a 2,000 gallon diesel heating oil tank were removed. The diesel UST was observed having several 1 inch holes in it and diesel product was observed in the excavation and on the groundwater at 9 feet below ground surface. The two soil samples collected below the diesel tank had 6,800 mg/kg DRO and 9,700 mg/kg respectively. While the benzene soil samples were non-detect (<0.05 mg/kg), given the presence of product VOC (including benzene), GRO, and PAH contamination is also expected above cleanup levels. Only DRO and BTEX samples were collected at the diesel tank location.
During the removal of the tanks at 35 cubic yard stockpile was generated and three soil samples were collected from it and it had up to 300 mg/kg DRO in the soil samples collected. This contaminated soil stockpile was used as backfill in the excavation.
Need release investigation to define the extent of the soil and groundwater contamination at this site and recover the product on the groundwater. The assessment did not include any information regarding any piping and dispensers associated with the tanks. If the diesel tank was used for heating there would have been piping from the tank to the building that also needs to be assessed. |

ADEC stopped by the office of Yellow Taxi but no one answered the door. The site of the former USTs is in the parking area in front of the building; as we passed it no odor or visual evidence of contamination in surface soil or puddles were observed and were not anticipated because the historical release was to subsurface soil and ground water. The playground next door was still active and just beyond that is Deer Creek; no stressed vegetation or surface disturbance indicating recent excavation was observed on the property. The area is serviced by the City of Ketchikan Public Water System. |

The release event ID 2311 for the Yellow Taxi Sourdough Cab on the LUST database is closed in an administrative action by the project manager. Soil sample data from the excavation combined with observations by registered UST workers at the UST closure site indicate that the regulated tank and piping was intact and a gasoline release had not occurred.
A corresponding petroleum release from the heating oil UST closed by removal at the same time is managed using the record on the Contaminated Sites Database under the name Yellow-Sourdough Taxi. |

DEC traveled to Ketchikan and met with John Flora at the facility. In discussion DEC verbally reminded Mr. Flora of his responsibility for costs incurred by the Department providing oversight during the site assessment, release investigation and corrective action cleanup process. The 1998 site activity to decommission the regulated gasoline underground storage tank (UST) was discussed and Mr. Flora stated that he had no prior knowledge of the second UST that was discovered leaking a mixture of oil and water to the surrounding subsurface soil. The abandoned UST was never in use prior to the discovery. An above ground storage tank supplied diesel to the boiler in the building. DEC described current opportunities now available to contract qualified environmental professionals locally and to dispose of minor quantities of diesel/heating oil contaminated soil at a DEC permitted facility in Juneau. Mr. Flora stated that he would look into those suggestions and consider them carefully. |

In accordance with the provision of Alaska Statute 46.08.075, the State of Alaska has executed a cost recovery lien to recover response costs the State has incurred investigating and responding to the release of hazardous substances on the Yellow Taxi property.
By virtue of its recordation, NOTICE IS HEREBY GIVEN that the State of Alaska, GRANTEE has a lien against all property, real or personal, belonging to John T. Flora, GRANTOR, within the Ketchikan Recording District, First Judicial District, State of Alaska, including but not limited to the following real property: land parcels Lots 1, 2, and 7-A Block 11, U.S. Survey 1381, Ketchikan Recording District, First Judicial District, State of Alaska. Survey 1381, filed June 22, 1979 as Plat No. 79-16, Ketchikan Recording District, First Judicial District, State of Alaska.
This lien is to secure payment of expenditures, plus interest on said expenditures, by the State for the costs of response, containment, removal, or remedial action resulting from an oil or hazardous substance spill, or from the substantial threat of such a release, at the Yellow Taxi facility located at 531 Deermount St., Ketchikan, Alaska. Pursuant to AS 46.08.075(b)(1), John T. Flora is identified as the person known to have caused a release of hazardous substances at and from the Yellow Taxi real property.

ADEC sent the responsible party a Compliance Advisory Letter. ADEC requested that the RP: 1. Provide a written response to DEC by November 30, 2022 indicating the timeline for completing the following two tasks. 2. Hire a Qualified Environmental Professional (QEP), in accordance with 18 AAC 75.333 and 18 AAC 78.088. Submit a work plan, prepared by a QEP, to DEC characterize soil and groundwater no later than March 31, 2023. The work plan must propose investigation of soil and groundwater contamination resulting from the underground diesel tank and identify the presence of any drinking water wells within 500 feet of the former underground tank.
