Problems/Comments
Site Investigation excavations at shop entrance trying to locate a historical waste oil sump reportedly plumbed from an off-site source resulted in a stockpile of contaminated soil. Diesel range organics (DRO) from 120 parts per million (ppm) to 3,700 ppm and residual range organics (RRO) from 250 ppm to 9,900 ppm were found in site screening soil samples collected from the excavations. Soil analysis also detected elevated levels of arsenic and chromium that are below applicable soil cleanup levels. The underlying soils are influenced by tides, and the fill material included hog fuel and large logs that hindered excavation of the site. No groundwater was encountered during the excavation. Contamination is reported to be less in soils under tidal influence, "close to original content without tidal influence."
Action Information
Action Date | Action | Description | DEC Staff |
---|---|---|---|
2/9/2001 | Site Added to Database | Petroleum contamination confirmed. | Bruce Wanstall |
2/12/2001 | Site Ranked Using the AHRM | Preliminary ranking. | Bruce Wanstall |
2/13/2001 | Update or Other Action | VCP invitation letter sent to responsible party. Letter also discussed possible contamination at site by KPC Thorne Bay Shop located next door. | Bruce Wanstall |
6/12/2001 | Update or Other Action | Second letter sent to RP regarding contamination on site. More definitive evidence needed before we can make a case to ask KPC to become involved. See G:/Spar-Contaminated Sites/SITES/DuRetteConstruction.doc. | Bill Janes |
3/4/2002 | Update or Other Action | Project tickler update - No action at this time. Need to think more about next steps. Does not appear RP has taken any action since last June. | Bill Janes |
4/29/2002 | Update or Other Action | Project tickler update - Letter sent to Butch DuRette asking to meet at the site on August 7 during the Prince of Wales visit. In site file on G drive. | Bill Janes |
8/8/2002 | Meeting or Teleconference Held | Met with Butch DuRette. Told him I would look into applying ACLs from KPCs shop next door. Cleanup needs may be very limited. | Bill Janes |
1/24/2006 | GIS Position Updated | Lat long data posted for the maintenance shop; metadata includes use of the DEC facility locator GIS module with personal knowledge of the site projected on aerial photographs of the facility. Scale is 1:12,176 feet, elevation data not available, estimate less than one hundred feet above sea level. Accuracy of Lat Long coordinates is estimated at medium, within 150 meters. | Bruce Wanstall |
2/26/2008 | Exposure Tracking Model Ranking | Initial ETM exposure pathway evaluation of the unknown contaminant source area completed. | Bill Janes |
5/19/2011 | Update or Other Action | Reassignment opening technical evaluation of the site file to determine the extent and history of residual soil contamination source area. The alleged off-site source of contamination for an oil separation sump is piping run to the former KPC Shop on the adjacent property. In the KPC cleanup investigation the alleged piping run was not identified. Subsurface soil sample from pit #3 in the southwest corner of the property analyzed in 2000 had DRO at 3,700 mg/kg and RRO at 9,900 mg/kg. | Bruce Wanstall |
11/13/2012 | Site Visit | In a plain view site inspection DEC observed the shop is still in place and land use is unchanged. | Bruce Wanstall |
12/18/2013 | Exposure Tracking Model Ranking | A new updated ranking with ETM has been completed for the unknown source area 74273 | Bruce Wanstall |
3/17/2015 | Exposure Tracking Model Ranking | A new updated ranking with ETM has been completed for source area 74273 Vehicle Maintenance Shop. | Bruce Wanstall |
3/18/2015 | Institutional Control Record Established | Institutional Controls established and entered into the database. Robert and Jacqueline Durette shall report intent to sell the property to DEC to ensure the new property owner will agree by signature to uphold the management agreement and Notice of an institutional control (IC) is recorded on the property identifying the nature and extent of contamination at the property and the conditions that the owners and operators are subject to in the future. Institutional controls will be removed in the future if documentation can be provided that shows cleanup levels have been met. | Bruce Wanstall |
4/15/2015 | Cleanup Complete Determination Issued | Although a smear zone influenced by tidally fluctuating sea water is present, and the substrate between the remaining contamination and Thorne Bay has a high permeability for contamination to migrate, no discreet point discharge of film, sheen, discoloration or floating oil has been identified on the intertidal shoreline and a consistent discharge has not been observed or reported. As a result, any residual soil contamination migrating to off-site surface water is not exceeding the Water Quality Standard. Petroleum contamination remains on-site in soil above approved cleanup levels; however DEC has determined there is no unacceptable risk to human health or the environment as long as the contamination is properly managed. A Notice of Environmental Contamination (deed notice) shall be recorded in the State Recorder’s Office as an institutional control (IC) that identifies the nature and extent of contamination at the property and the conditions that the owners and operators are subject to in accordance with this decision document. | Bruce Wanstall |
4/23/2015 | Institutional Control Compliance Review | IC compliance review conducted and staff changed from Bruce Wanstall to IC Unit. Reminder system initiated to follow-up with the responsible party annually. | Kristin Thompson |
5/19/2016 | Institutional Control Compliance Review | IC compliance review conducted. Never received the signed ICs agreement page from the responsible party. Issued an IC reminder letter requesting signature. | Kristin Thompson |
5/24/2016 | Institutional Control Update | Contacted via telephone by the property owner who informed me that there has been no sheen or evidence of contamination along the shoreline of their property. | Evonne Reese |
4/4/2019 | Institutional Control Update | An Institutional Controls reminder letter was mailed to the landowners on this date. | Mossy Mead |
