Problems/Comments

Since July of 2001, heating oil has been observed floating on groundwater collected from monitoring well G-14. The source of this heating oil is not clear since heating oil contamination is known to exist in soil and groundwater east of the Eagle River Shopping Center at the Lazy Mountain Trailer Park. Lazy Mountain Trailer Court is east of the site. See ADEC file number 2107.38.001.

10/5/2005 Update or Other Action A letter was submitted to James Wilkens responding to his request to hold the owners and operators of Lazy Mountain Trailer Court responsible for contamination on-site. The letter stated that the source of contamination at Eagle River Shopping Center is unknown at this time. Mr. Moeller is presently a potential responsible party. At this time, the Department requests that Mr. Moeller hire an independent, qualified third party to meet with the Department in order to construct a site investigation work plan for determining the source of contamination at ERSC. The site investigation should be constructed such that it is dynamic in nature and legally defensible. Following a review of the site investigation report, the Department will make a determination as to source of contamination at ERSC. Update: ERSC must submit work plan by July 31, 2006. Todd Blessing
5/15/2006 Update or Other Action Reviewed letter, authored by James Wilkens, dated May 11, 2006. Mr. Wilkens claims that his client, Eagle River Shopping Center Corp., is not strictly liable for contamination on Eagle River Shopping Center. Mr. Wilkens also stated that he will hire David N. 8/30/2006 Conditional Closure Approved ADEC has determined that ERSC site is eligible for conditional closure. This determination recognizes that there are areas of soil contamination remaining above the most stringent 18 AAC 75 soil cleanup levels established for the site. However, subject to site specific conditions, the contamination does not pose an unacceptable risk to human health or the environment. Todd Blessing
