Problems/Comments

As part of a fencing project, a post was placed at the corner of the house. The fence post severed the heating oil return line. Over the next three weeks approximately 1000 gallons of #2 diesel heating oil were released to the subsurface. Response actions included the removal of 143.5 tons of contaminated soil and the recovery of approximately 500 gallons of fuel from the groundwater surface.

2/8/2007 Update or Other Action Received a call from Lyle Gresehover regarding future management of the site. We discussed the fact that wells on adjacent properties have been sampled and were not impacted by the spill. The owner is still recovering a few gallons of fuel as it accumulates on top of the frozen groundwater. Lyle thought a passive skimmer system would work well for product recovery this summer. I suggested we collect a sample from the on-site well this winter, and put in a down-gradient monitoring well in the spring. After sampling the downgradient monitoring well we can evaluate a long term strategy for the site. Kim DeRuyter
4/16/2007 Long Term Monitoring Established ADEC sent a letter to the owners of the property establishing an IC for the annual monitoring of the on-site drinking water well. Deborah Williams
4/16/2007 Update or Other Action ADEC sent a letter to the owners stating that an additional downgradient monitoring well was required. All the monitoring wells should be monitored annually at high water table for the next three years. If after three years of data, the data shows a decreasing or steady state plume, then re-evaluate the monitoring schedule. Deborah Williams
4/19/2007 Update or Other Action Received an email for the Prewitt's. They stated that since the spill, they have recovered over 295 gallons of oil product from the recovery well. Deborah Williams
8/6/2007 Potentially Responsible Party/State Interest Letter A letter was sent to Denali Fenceworks (Joe Vargus) regarding their potential responsibility / liability associated with the release of heating fuel from the broken pipe. They were requested to respond to the matter and provide information. Jim Frechione
8/21/2007 Update or Other Action Denali Fenceworks (Joe Vargas) responded with a detailed description of the events leading up to their installation of the fence at the Prewitt residence. he indicated Mr Prewitt established the location of the fence post that damaged the fuel line and did not consider his company liable for the associated damages Jim Frechione
3/21/2008 Update or Other Action Staff reviewed file for a response to PDC regarding a proposed utility line installation in the area. The contaminated soil has been excavated, except for the impacted soils that are beneath the house. There remains some free phase petroleum on the water table and a groundwater plume that has not been completely delineated. The plume, however, appears to be fairly limited in extent based on sampling neighboring drinking water wells and one on site monitoring well. ADEC has requested additional monitoring. The utility project should not encounter any soil contamination based on their current proposal to only dig in the road. Groundwater contamination could be a concern if there was extensive dewatering. The closest proposed lift station is approximately 1,000 ft away from the site. Ann Farris
3/21/2011 Update or Other Action Staff reviewed the January Groundwater Monitoring Report. The diesel concentrations increased in MW-3 from 2010. Given the concentrations of benzene and proximity to the garage, vapors in the building are a possibility. Residual soil contamination beneath building and unrecoverable fuel on water table. Don't suspect off site migration, but unable to completely delineate. Will collect some air samples and another groundwater sample. Owners have done as much source removal as possible. Did not receive money from the fence company that drilled through the tank. They want to sell the property, but these data are insufficient for a closure at this time. Set up a meeting for April 1. 7/31/2017 Update or Other Action Conducted a site visit to provide guidance to homeowner regarding monitoring well decommissioning. Monitoring wells 1-3 were cut off 1 foot below grade and sealed with bentonite. Michael Hooper
8/3/2017 Cleanup Complete Determination Issued A Cleanup Complete - Institutional Controls determination has been made for this site. Remaining soil contamination is inaccessible under the garage and the groundwater plume is stable and decreasing. A notice of environmental contamination has been filed with the DNR recorder's office and institutional controls are in place requiring management of contaminated soils and restricting groundwater well installation. Requirements

Description Details

Movement or use of contaminated material (including on site) in a manner that results in a violation of the water quality standards is prohibited (18 AAC 70) Standard condition.
When Contaminated Soil is Accessible, Remediation Should Occur In the event that the remaining contaminated soil becomes accessible in the future due to the building being removed, the land owner shall notify ADEC, characterize, and, if determined necessary, cleanup the soil.
Groundwater Use Restrictions No additional groundwater wells shall be installed on the subject property covered by the institutional controls without prior DEC approval.
Other The Landowner agrees to notify ADEC prior to any sale or transfer of the property and shall report to ADEC every 5 years to document the status of compliance with the institutional controls described in this notice.
