Problems/Comments

Mercury and arsenic is present in tailings piles, and free mercury is present in site soils associated with a large mercury processing (retorting) operation that ceased operation in the early 1970s. Petroleum hydrocarbon is present in various locations associated with maintenance shops. Other contaminants associated with mercury mining also present. CERCLA AKD980495618. This approximately 10-acre site is owned by BLM.

8/1/2000 Update or Other Action Staff traveled with BLM and its contractor representatives, as well as a USGS mercury researcher, to the mine site. The line of massive mercury condensation tubes associated with the retort operation have been demolished and stockpiled for landfilling in a soon-to-be-proposed on-site Class 1 landfill. BLM believes it has the support of the nearby community of Red Devil for the landfill proposal, and plans to go through the steps needed to obtain an ADEC solid waste disposal permit. Mercury cleanup levels have not been determined for the site, and site characterization of the most heavily contaminated area, centered on the former retort, is underway. BLM is boring approximately 100 five- to ten-foot deep test holes which will be analyzed in the field using an X-Ray Fluoroscope (XRF), with two of each five samples also being analyzed in the lab for total mercury. BLM staff stated that they believe they will be able to landfill any mercury contaminated soil which does not fail the Toxicity Characteristic Leaching Procedure (TCLP). CSRP staff will coordinate with the EPA and Solid Waste Program on this project. Eileen Olson

6/10/2002 Update or Other Action Wayne Svejnoha, BLM, informally told Leslie Simmons, ADEC SWP, that they are not required to obtain approvals from the State for the work in the 5/20/2002 draft plan and that it was merely advisory in nature. The BLM moved equipment onto the site on 06 June 2002 without State involvement or approval. This site has been referred to the Directors of Solid Waste and SPAR. Lynne Bush
6/12/2002 Meeting or Teleconference Held Present at 12 June 2002 meeting: BLM representative, Wayne Svejnoha; ADEC representatives, Leslie Simmons, Jennifer Roberts, and Lynne Bush; and representatives of the Attorney General’s Office, Chris Kennedy and Margaret Paton-Walsh. At issue is the lack of Department involvement/approval with plans to characterize, remediate or dispose of contamination associated with the abandoned Red Devil Mine. The BLM has personnel on site performing work activities without approval from either the Contaminated Sites Program or the Solid Waste Program. Activities include removal of debris and the construction of monofills. Also discussed cost recovery issues and research into potential responsible parties other than BLM. The BLM will provide the Department with reports and documents not previously submitted and will work with Solid Waste and Contaminated Sites to bring the Red Devil project up to date with required permits and approvals. 2/17/2004 Update or Other Action The following information was provided by the Solid Waste Program: Approximately two years ago BLM established an industrial landfill for the metal-contaminated debris and an inert landfill for the other wastes. They completed the two landfills without DEC approvals. DEC (Glascott) inspected the area and reported general satisfaction except for a couple of areas prone to erosion. Lynne Bush

1/23/2009 Update or Other Action Petroleum Contaminated Stockpiles -- approx. 2410 cy of petroleum contaminated soil is stockpiled in two stockpiles. Stockpiles have been at the site since 2005 and 2006 and are uncovered. Per 18 AAC 75, stockpiles can not be present for longer than 2 years and must be kept covered. 3/10/2016 CERCLA FS On this date, the DEC sent a letter of non-concurrence on the Red Devil Mine Final Feasibility Study Report, dated 3/2016. The letter states that the reasons for the non-concurrence are: 1) "DEC believes that BLM did not include all Applicable or Relevant and Appropriate Requirements (ARARs) for Alternatives 3a, 3b, 3c, and 3d, nor has BLM provided a sufficient legal response as to why the Alaska Solid Waste regulations of 18 Alaska Administrative Code (AAC) 60.025, 18 AAC 60.485, and 18 AAC 60.330(b) are not applicable or relevant and appropriate.", and 2) "The repository, as currently designed for Alternatives 3a and 3c, does not meet the design specifications required under Alaska law. State law requires that such disposal sites include a bottom liner and leachate collection system, unless sufficient hydrogeologic modeling has been conducted to demonstrate they are not necessary. To date, insufficient design and modeling have been conducted to support such a determination. Although the language in the Final FS regarding future modeling efforts shows a higher level of commitment than the language in previous draft documents, we still believe that it does not fully achieve what is necessary. BLM has not committed to working in collaboration with DEC to conduct additional modeling, nor has BLM stated what actions will be taken if the modeling demonstrates that the repository as designed is not protective." 9/14/2020 Update or Other Action Staff reviewed a tech memo developed by BLM outlining areas in the Main Processing Area where arsenic was found to exceed the RCRA hazardous waste criteria of 5 mg/L using TCLP. The data used for this mapping exercise was previously presented in the Remedial Investigation, Remedial Investigation Supplement, and Groundwater reports. Based upon this compiled data set, it is now estimated that the volume of material for excavation is almost 205,000 cubic yards and the volume of material exceeding arsenic TCLP criteria is almost 16,000 cubic yards. 3/15/2024 Document, Report, or Work plan Review - other DEC provided a comment letter about the Record of Decision to BLM on this date. DEC agrees that the cleanup can be conducted to result in a remedy that is protective of human health and the environment. There are several topics that DEC requested clarification on.
