Problems/Comments

Site discovery in 1990 following complaint that petroleum hydrocarbon and petroleum product runoff was taking place at a junkyard/auto repair shop operating on the property. Numerous surface spills were observed during inspections by ADEC spill response staff. Contamination was discovered during removal of a regulated underground storage tank (UST) in 1994 that was not associated with the UST. Staff reviewed the site investigation and remedial action report of January 28, 1994 and closed the portion of the site suspected of PCB contamination on December 15, 1994, noting also that no contamination was identified during the removal of the regulated UST. The site remained open based on the numerous surface petroleum spills. These were evaluated and cleaned up with work beginning after 2006. Following a demonstration that soil to a depth of two feet throughout the site did not contain contaminants above applicable cleanup levels, the site as a whole was closed.

10/9/2000 Update or Other Action Reviewed file in response to inquiries into site status during the week of October 2nd. Toghottelle Corp., former owner, wanted to know if ADEC had shut down the salvage yard at this site for a period of years. The Corp. was trying to establish, on behalf of the current owner, whether MOA zoning was wrong in disallowing further use as a salvage or equipment repair yard. If use of the property as a salvage or maintenance yard was not continuous, it would have lost its grandfather rights for its location in a residential neighborhood. If the hiatus in commercial use is the result of a government action, grandfather rights would have been retained. ADEC did not shut down or restrict commercial operation, although it obtained a search warrant for sampling surface stains and investigating stored materials. Eileen Olson

Stockpiles that were present over grid sampling locations during site visit are to be evaluated by field screening, with soil to be segregated if necessary and moved to allow completion of sampling according to the grid in the approved work plan.
