(Old R:Base Action Code = RPL2 - Site Information Request Letter). Sent a site request letter regarding contaminated soil removal and remaining contamination. Requested actions by ADEC include: immediately retrieving the contaminated soil from the Big Dipper Construction Company's gravel pit and placing it in a proper contaminated soil storage cell; retain a qualified 3rd party to characterize the contamination in the stockpile so that a treatment method can be determined, develop a sampling plan for the shop property that will characterize the fenced area where the soil was previously stored and characterize the former excavation site at the shop and determine if the prior cleanup activities were satisfactory; and, have the septic tank pumped out by a company capable of handling oil-type wastewater.
The 8/8 letter also reiterated a 8/7/95 conversation between Krieber and Howard Carr, owner of Wasilla Machine Shop property, in which Carr stated that the contaminated soil transported off site by Big Dipper (i.e., transported to the owner of Big Dipper's property, Paul Minick) was transported on 8/2/95 to Carr's property located at Lot A2 Replat of Tract A, 3rd Addition Butler Subdivision near Big Lake and placed in a covered cell. |

(Old R:Base Action Code = SA2R - Phase II SA Review (CS)). In review of Hulbert's "Closure Investigation" report dated September 1995 that was received at ADEC on 10/2/95, on 10/30/95 Krieber issued a No further action letter for investigation or cleanup at this property. Hulbert's report showed that TPH, which was the only COC that was analyzed for around the sewer line break and in accordance to their approved work plan, showed a maximum of 412 mg/kg TPH.
However, the letter noted that DRO and RRO in exceedance to cleanup levels were detected in soil removed from the site and stockpiled offsite, i.e., at: Lot A2 Replat of Tract A, 3rd Addition Butler Subdivision near Big Lake, Alaska. The letter noted that in a 10/3/1995 phone call between Krieber and Hulbert (representing Howard Carr the property owner of both sites) that cleanup would occur at the off-site location until level B cleanup criteria was met, i.e. 200 mg/kg DRO and 2,000 for TPH.
This site and the original site from which the stockpiled soils were removed from will not be considered closed until the contaminated soil stockpile has been processed per department regulations. |

On 6/28/01, Sundet contacted Hulbert and requested assistance to resolve the issue with the contaminated soil that was moved off site to Lot A2, Replat of Track A, 3rd Addition, Butler Subdivision near Big Lake, Alaska. Hulbert contacted the property owner of the former Wasilla Machine Shop, i.e. the widow of Howard Carr, who also still owns Lot A2...Butler Subdivision. Carr requested that Hulbert resolve the issue by obtaining closure on Lot A2. |

On 8/7/01, ADEC issued a letter to the owner of the former Wasilla Machine Shop (now Husky Electric) and who is also the owner of Lot A2...Butler Subdivision where excavated soil from Wasilla Machine Shop was disposed/stockpiled in 1995. ADEC informed Carr that the letter was in follow-up to her consultant Ralph Hulbert's 7/30/01 dated sampling report (received at ADEC on 8/1/01) of the stockpile on Lot A2... Butler Subdivision. The letter informed Carr that the samples met cleanup levels specified in DEC's 10/30/1995 letter and cleanup levels specified in DEC's 12/23/1999 "Off Site Disposal of Soil Not Requiring Institutional Controls" dated December 23, 1999.
The letter also requested that Carr return an accompanying document with her signature to meet one of the conditions in the off site policy document. The letter noted that with receipt of the returned signed document, ADEC would issue a closure letter for the site, including for Lot A2...Butler Subdivision. |

On 8/21/2001, ADEC issued a letter to the property owner of Lots 1, 2, 3, Block 5, Wasilla Townsite (Formerly Wasilla Machine Shop and currently Husky Electric) contaminated site that based upon review of the file, that the site is "closed" and no further action is required.
The letter noted that previously on October 30, 1995, ADEC had notified the property owner that testing, which was done in accordance to an ADEC approved work plan, showed that soil contaminant levels were below regulatory concern (i.e., a maximum of 412 mg/kg total petroleum hydrocarbons was detected and the ADEC cleanup guidance standard was 2,000 mg/kg). The October 30th letter also noted that while no further action was required to cleanup the site, soil that had been moved off-site still needed to be addressed. Contaminated soil had been excavated at the subject property, and transported and stockpiled off-site on Lot A2, Replat of Tract A, 3rd Addition Butler Subdivision near Big Lake, Alaska. On 8/7/2001, ADEC notified Ms. Kathleen Carr, the property owner, that recent confirmation sampling performed by the property owner's environmental consultant showed that the stockpiled soil was below the most stringent regulatory cleanup levels for the under 40 inch annual precipitation zone, i.e., below 18 AAC 75 Table B2 cleanup levels of 250 mg/kg diesel range organics (DRO) and 10,000 mg/kg residual range organics (RRO); confirmation sampling showed 66.8 mg/kg DRO and 444 mg/kg RRO.
The August 7th letter also informed Carr that ADEC has a current policy (“Off-Site Disposal of Soil Not Requiring Institutional Controls” dated December 23, 1999) that describes the manner in which contaminated soil can be moved off-site of where the soil originally came from to another location without requiring an institutional control (IC) be placed onto the recipient property (e.g., a deed notice) (enclosed). On page 2 of that guidance document, are listed the criteria where an IC is not needed. One of the criteria listed was that the property owner of where the soil was to be disposed of, provide written documentation to ADEC that they are allowing the soil to be disposed of on site and that they are the property owner.
The following is other criteria noted in the guidance policy that allows off-site disposal without requiring an IC be placed onto the recipient property:
- The site and proposal off-site disposal location is in the Under 40 inch or Over 40 inch annual precipitation zone:
- The off site disposal location is not an environmentally sensitive area;
- Soil is not placed within 100 feet of water wells, surface waters, and drainage ditches;
- Hazardous substances in the soil meet the most stringent soil cleanup levels in Tables B1 and B2 of 18 AAC 75.341 for the applicable zone.
The August 7th letter requested that Carr sign and return a document showing that she is the property owner of Lot A2….Butler Subdivision. On August 17, 2001, ADEC received the signed form from Carr stating that she is the property owner of Lot A2…Butler Subdivision.
The 8/21/01 letter also approved that the contaminated soils that were moved to Lot A2, Replat of Tract A, 3rd Addition Butler Subdivision near Big Lake, Alaska can be disposed of on that property provided that the soils are not placed in an environmentally sensitive area or within 100 feet of water wells, surface waters, and drainage ditches. |
