EDMS Name change or transfer of Ownership form

Instructions for completing a Name Change or Transfer of Ownership Form for stormwater discharges associated with APDES permits using EDMS.

Contact Information

Enter contact information for the entity that operates the project described in this application. An operator/onsite contact of a project is a legal entity that controls at least a portion of site operations and is not necessarily the site manager. Enter the operator's mailing address, telephone number, and e-mail address. Correspondence for the NOI will be sent to this address.

Enter contact information for the Applicant (Permittee), and Billing contact. Enter the name of the contact person and the legal name of the firm, public organization, or any other public entity that is responsible for accounts payable for this project. Correspondence for billing purposes will be sent to this address.

Multiple roles may be selected per contact.

Permit Information

Permit information should auto-complete.

Facility Information

Select the action to indicate a Facility Name Change or Transfer of Ownership.

If Facility Name Change:

Enter the new business name. The name will appear on the permit and must be the active business name registered with the State of Alaska Division of Corporations, Business, and Professional Licensing, unless otherwise exempted by their regulations.

Enter Effective or Scheduled Date of Facility Name Change.

Indicate whether the Facility Name Change will result in a change in the character of pollutants being discharged or a new or increased discharge not addressed by current permit conditions. If yes, attach an explanation.

Note: The signature of the Responsible Party or duly authorized representative must be obtained before DEC changes the facility name.

If Transfer of Ownership: Enter Effective or Scheduled Date of Transfer of Ownership.

Enter New Owner Contact Information.

Indicate whether the Transfer of Ownership will result in a change in the character of pollutants being discharged or a new or increased discharge not addressed by current permit conditions. If yes, attach an explanation.

Note: A permittee may not transfer a permit for a facility or activity to any person except after notice to DEC. Notice should be provided a minimum of 30 days prior to the proposed transfer date. Please provide a written agreement containing a specific date for transfer of permit responsibility, coverage, and liability between the current and new permittee.

This section allows you to review the form to confirm the form is populated completely and accurately, prior to certification and submission.

Signing

This section allows you to either sign the form or send an email invitation to have someone else sign the form.

Check box "Me" if you are signing the form. Select the "Sign" button to continue. (You may also select "Finish Later" to continue submission to a later time.) The next page presents the Signature requirements for permit applications and reports (18 AAC 83.385). If you agree to the terms, check the box and select โ€œSignโ€. You may also select "Cancel".

Check box "Someone Else" if you will be sending an email invitation to have someone else sign the form. Enter the user's email who will sign the form, including optional instructions. Select "Send Invite". (You may also select "Finish Later" to continue submission to a later time.) The next page gives you the opportunity to "Cancel Signing" or "Rescind Invite".

At the time of submission, the form will be transmitted to DEC, and it will become part of the public record.
