EDMS Pesticide General Permit (PGP) NOI
Instructions for Completing a Notice of Intent (NOI) Form for Stormwater Discharges Associated with Activity under an APDES Pesticide General Permit (PGP) using EDMS.
Pesticide General Permit - Decision Tool
Indicate whether you will be applying or hiring someone to apply pesticides that will result in a discharge to waters of the U.S. (as defined in Appendix C of the permit). If no, you do not need an APDES permit. If yes, continue with application.
Indicate whether the biological pesticide, or a chemical pesticide that you will apply, will leave a residue. If no, you do not need an APDES permit. If yes, continue with application.
Indicate whether your discharges to waters of the U.S. are solely a result of agricultural stormwater runoff or irrigation return flow. If yes, you do not need an APDES permit. If no, continue with application.
Indicate whether you will be applying pesticides within the Metlakatla Indian Reservation, or within the Denali National Park Preserve. If yes, you do not need an APDES permit. If no, continue with application.
Indicate whether the pesticide application will be for one of the following pesticides use patterns: Mosquito and Other Flying Insect Pest Control, Weed and Algae Control, Animal Pest Control, Forest Canopy Pest Control. (See Part 1.1.1 of the permit for further detail.) If no, you do not need an APDES permit. If yes, continue with application.
Indicate whether your discharge from the application of pesticides will be to any of the following: -to waters identified as impaired by a substance which either is an active ingredient in that pesticide or is a degradate of such an active ingredient (Part 1.1.2.1); or to a Tier 3 water, unless the purpose is to restore or maintain water quality or protect public health, and the resulting discharge either does not degrade water quality or only degrades water quality on a short-term or temporary basis (Part 1.1.2.2); or a discharge that is previously or currently covered by another APDES permit. If yes, you do not need an APDES permit. If no, continue with application.
Contact Information
Enter contact information for the entity that operates the project described in this application. An operator/onsite contact of a project is a legal entity that controls at least a portion of site operations and is not necessarily the site manager. Enter the operator's mailing address, telephone number, and e-mail address. Correspondence for the NOI will be sent to this address.
Enter contact information for the Applicant (Responsible Official), and Billing contact. Enter the name of the contact person and the legal name of the firm, public organization, or any other public entity that is responsible for accounts payable for this project. Correspondence for billing purposes will be sent to this address. See 18 AAC 72.956 for applicable authorization fee to be paid with the submittal of the NOI.
Multiple roles may be selected per contact.
Select the Operator Type.
Indicate whether you are a large entity as defined in Appendix C of the permit. If yes, you are required to develop a Pesticide Discharge Management Plan (PDMP) and submit an Annual Report reflecting all pesticide uses for which you are requesting permit coverage under this NOI. Please complete PDMP from template link.
Attach the completed PDMP form.
Pesticide Management Areas
Enter the Pesticide Management Area Name.
Attach the Pesticide Management Area Map.
Enter the Pesticide Management Area Description.
Enter the Pesticide Applicator Contact Information.
Select all applicable Pesticide Use Patterns to be included in this Pest Management Area.
Select the Receiving Waters Coverage requested.
Indicate whether the receiving water(s) coverage is for discharge to a Tier 3 (Outstanding National Resource Water) water of the U.S. If yes, enter the name of the Tier 3 water(s).
Provide rationale for determination that pesticide discharge is necessary to protect water quality, the environment, and/or public health and that any such discharge will not degrade water quality or will degrade water quality only on a short-term or temporary basis.
Select whether the receiving water(s) are impaired by any substance which is either an active ingredient of a pesticide to be discharged or a degradate of such an active ingredient; or water(s) are on a current state list as being impaired by a substance which is either an active ingredient of a pesticide to be discharged or a degradate of such an active ingredient; however, evidence is attached documenting that the waters are no longer impaired.

This step allows you to review the form to confirm the form is populated completely and accurately, prior to certification and submission.
Certify and Submit
This step allows you to certify the form as complete and accurate and to submit the form to DEC for review and processing.
At the time of submission, it will be transmitted to DEC and it will become part of the public record.
