New Source Performance Standard (NSPS) for Stationary Internal Combustion Engines

New Source Performance Standards (NSPS) of 40 CFR 60 Subpart IIII apply to:

  • Owners and Operators of stationary compression ignition internal combustion engines (CI ICE) that began construction after July 11, 2005 and meet the following requirements:
    • manufactured after April 1, 2006 and are not fire pump engines
    • manufactured after July 1, 2006 as a certified National Fire Protection Association (NFPA) fire pump engine
  • Owners and Operators of any stationary CI ICE that are modified or reconstructed after July 11, 2005.
  • Manufacturers of stationary CI ICE with a displacement of less than 30 liters per cylinder for:
    • 2007 or later model engines that are not fire pump engines
    • certain model year fire pump engines (see 40 CFR 60.4200(a)(1)(ii))

NSPS Fuel Requirements, 40 CFR 60.4207

  • Beginning October 1, 2010, owners and operators of stationary CI ICE subject to 40 CFR 60 Subpart IIII with a displacement of less than 30 liters per cylinder that use diesel fuel must use diesel fuel that meets the requirements of 40 CFR 80.510(b), which requires maximum sulfur content of 15 ppm, for non-road diesel fuel, except that any existing diesel fuel purchased (or otherwise obtained) prior to October 1, 2010, may be used until depleted.
  • Beginning June 1, 2012, owners and operators of stationary CI ICE subject to 40 CFR 60 Subpart IIII with a displacement of greater than or equal to 30 liters per cylinder must use fuel that meets a maximum per-gallon sulfur content of 1,000 parts per million (ppm).

NSPS Exemptions, 40 CFR 60.4216

  • The provisions of 40 CFR 60.4207 do not apply to owners and operators of pre-2014 model year stationary CI ICE subject to 40 CFR 60 Subpart IIII that are located in areas of Alaska not accessible by the Federal Aid Highway System (FAHS).
  • The provisions of 40 CFR 60.4216 and 40 CFR 60.4207 do not prevent owners and operators of stationary CI ICE subject to 40 CFR 60 Subpart IIII that are located in areas of Alaska not accessible by the FAHS from using fuels mixed with used lubricating oil, in volumes of up to 1.75 percent of the total fuel. The sulfur content of the used lubricating oil must be less than 200 parts per million. The used lubricating oil must meet the on-specification levels and properties for used oil in 40 CFR 279.11.

National emissions Standard for Hazardous Air Pollutants (NESHAPS)

NESHAPs of 40 CFR 63 Subpart ZZZZ apply to:

  • Owners and Operators of any existing, new, or reconstructed stationary reciprocating internal combustion engines (RICE) located at a major or area source of hazardous air pollutant (HAP) emissions, excluding stationary RICE being tested at a stationary RICE test cell/stand.
    • “Existing”, “new”, and “reconstructed” are described under 40 CFR 63.6590(a)(1)-(3)
    • Major and area sources of HAP emissions are defined under 40 CFR 63.6585(b) and (c)
    • Stationary RICE subject to limited requirements and stationary RICE subject to regulations under 40 CFR Part 60 are described under 40CFR 63.6590(b) and (c).

NESHAP Fuel Requirements, 40 CFR 63.6604

  • If you own or operate an existing non-emergency, non-black start CI stationary RICE with a site rating of more than 300 brake HP with a displacement of less than 30 liters per cylinder that uses diesel fuel, you must use diesel fuel that meets the requirements in 40 CFR 80.510(b) for non-road diesel fuel, which requires maximum sulfur content of 15 ppm.
  • Beginning January 1, 2015, if you own or operate an existing emergency CI stationary RICE with a site rating of more than 100 brake HP and a displacement of less than 30 liters per cylinder that uses diesel fuel and operates or is contractually obligated to be available for more than 15 hours per calendar year for the purposes specified in 40 CFR 63.6640(f)(2)(ii) and (iii) or that operates for the purpose specified in 40 CFR 63.6640(f)(4)(ii), you must use diesel fuel that meets the requirements in 40 CFR 80.510(b) for non-road diesel fuel, except that any existing diesel fuel purchased (or otherwise obtained) prior to January 1, 2015, may be used until depleted.
  • Beginning January 1, 2015, if you own or operate a new emergency CI stationary RICE with a site rating of more than 500 brake HP and a displacement of less than 30 liters per cylinder located at a major source of HAP that uses diesel fuel and operates or is contractually obligated to be available for more than 15 hours per calendar year for the purposes specified in § 63.6640(f)(2)(ii) and (iii), you must use diesel fuel that meets the requirements in 40 CFR 80.510(b) for non-road diesel fuel, except that any existing diesel fuel purchased (or otherwise obtained) prior to January 1, 2015, may be used until depleted.

NESHAP Exemptions, 40 CFR 63.6604

  • Existing CI stationary RICE at area sources in areas of Alaska that meet either 40 CFR 63.6603(b)(1) or (2), or are on offshore vessels that meet 40 CFR 63.6603(c) are exempt from the requirements of 40 CFR 63.6604.
