Summary of Chapter 79

18 AAC 79 establishes Alaska’s regulatory framework for identifying, evaluating, and certifying properties used for illegal drug manufacturing to ensure they are properly cleaned and deemed safe for reuse. This chapter:

  • Requires the department to receive and publicly list properties identified by law enforcement as illegal drug manufacturing sites, including property details and parcel information per legal mandate
  • Mandates sampling, testing, cleanup procedures, and specific fitness-for-use standards, including lab reporting and certification, to ensure sites meet health and environmental safety criteria
  • Removes properties from the official list only after they are certified fit-for-use, remain listed for five years post-certification, and then are formally deleted within three months in accordance with statute.
