Summary of Chapter 83
18 AAC 83 establishes Alaska’s Alaska Pollutant Discharge Elimination System (APDES), governing the permitting, monitoring, and enforcement of pollutant discharges from point sources into waters of the United States in compliance with state and federal Clean Water Act standards. This chapter:
- Implements a state-administered NPDES program (APDES) that requires permits for any point-source discharge into U.S. waters, following clean water objectives and federal guidelines
- Adopts federal regulations by reference (notably 40 CFR Part 122) and sets definitions and procedures for applications, general and individual permits, and permit timelines
- Enables enforcement through general provisions including monitoring, reporting, exclusions (such as sewage sludge under CFR Part 503), and vesting authority contingent upon EPA program approval
