DEC has adopted amendments to allow the use of performance based approaches (PBAs) to develop site specific criteria, and adopted a performance based approach to develop site specific criteria for copper protective of aquatic life in freshwater, effective May 3, 2026. Locations where the copper PBA is applied will be listed here, including links to relevant documents.
